2 WIIEREAS, Chapter 293 of the Saint Paul Legislafive Code was enacted to regulate the subject of noise in
3 the City of Saint Paul; and

5 WHEREAS, §293.11 provides for the granring of variances from the sound level limitations contained in
6§293.09, upon a finding by the City Council that full compliance with Chapter 293 would constitute an
7 unreasonable hardship on an applicant, other persons or on the community; and
8
9 WHEREAS, St. Paul After Hours, represented by Brian Harst, CEO, who has been designated as the
10 responsible person on the application, has applied for a variance to allow amplified music at Mears Park, 220 6`�
11 Street E., on September 8, 15, 22 and 29, 2005; and

13 WHEREAS, applicant is seeking a variance for the hours of 5:00 p.m. to�}9�p.m. on September 8, 15, 22
14 and 29, 2005 and

16 WHEREAS, if applicant is not granted a variance it will not be able to present the amplified music ; and

18 WHEREAS, the Office of License, Inspections, and Environmental Protection has reviewed the application
19 and has made recommendarions regarding conditions for the variance; now, therefore, be it
20
21 RESOLVED, that the Council of the City of Saint Paul hereby g�ants a variance to St. Paul After Hours,
22 subject to the following condirions:

24 1) The variance shall be for the hours of 5:00 p.m. to�:'6b'p.m. on September 8, 15, 22
25 and 29, 2005.

27 2) Ali electronically powered equipment used in conjunction with the event shall not
28 exceed 85 dBA as measured at a distance of 50 feet from the source of the sound.

30 3) The applicant shall provide personnel and equipment who shall provide continuous
31 sound level monitoring at all stages and each sound mix between 5:00 p.m. to 9c8@
