As a result, an estimated 792,000 hockey fans did not visit the City and the Xcel Arena; and W HEREAS, the canceled hockey season had a negative economic impact on a variety of the City's business and cultural institutions that rely in part on revenue derived from fans attending hockey games at the Xcel Arena; and WHEREAS, the City desires to acknowledge its appreciation of Wild hockey fans and to welcome all fans of hockey back to Saint Paul and the Xcel Arena; and WHEREAS, In order to rekindle the excitement and atmosphere associated with hockey games played in the Xcel Arena as events that are unique to and in keeping with the City's tradition as the premier venue for amateur, prep, collegiate and professional hockey, the City desires to display on City light poles located in the vicinity of the Xcel Arena, small banner style signs conveying a message to hockey fans of "welcome back" to Saint Paul; and W HEREAS, the City's zoning code is silent about the use of the City's light poles as fixtures upon which to display banner signs although City light poles have often been used for similar purposes. The lack of a specific reference or regulation regarding ihe use of City light poles as structures for displaying banner signs necessitates the need for a determination of whether City light poles may be used for the purpose of displaying the signs envisioned for the City's "welcome back" signage; and WHEREAS, Minn. Stat. § 462.3597 establishes a process for the governing body of a municipality to temporarily permit the interim use of property until a particular date; and WHEREAS, Minn. Stat. § 462.3597, Subd. 2 specifically provides that governing body may grant permission for an interim use upon making the following four findings: (1) the use conforms to the zoning regulations; (2) the date or event that will terminate the use can be identified with certainty; oS- 8ao � 2 3 4 5 6 7 8 9 10 il 12 13 14 15 16 17 18 19 20 21 22 23 24 25 (3) permission of the use will not impose additional costs on the public if it is necessary for the public to take the property in the future; and (4) the user agrees to any conditions that the governing body deems appropriate for permission of the use: ana WHEREAS, the bannezs will not identify the Wild, the NHL, professional hock NOW, THEREFORE, BE IT RESOLVED, that the Council of the City of Saint Paul find: that the use of City I+ght poles to display banner signs to welcome back professional hockey fans to the City's Xcel Arena communicates an important public message intended to encourage fans attending professional hockey games at the Xcel Arena to patronize ihe City's businesses and cultural insiiiutions in the vicinity of the Xcel Arena; AND, BE IT FINALLY RESOLVED, that the interim use of the light poles is approved based upon the following findings set forth in Minn. Stat. § 462.3595, Subd.2(1-4): (1) Temporary banner signs are permitted uses under the zoning code. Use of light poles to display the banner signs will facilitate this permitted use. (2) The temporary banner signs in question will no longer be necessary following the opening day of the hockey season on October#�r, 2005.
