WHEREAS, in accordance with Sections 64.07 and 64.08 of the Saint Paul Administrative Code, City real
estate staff approved the deferment oF assessment Project No. 0539 (Grade, Pave, Lights) for H. Arnold Holtz
of 1858 Bayard commencing on September 5, 1991; and

WHEREAS, on March 26, 2000 said property was conveyed to Mr. Holtz' daughter, Jan L. Holtz; and
WHEREAS, in July, 2005 City real estate staff became aware of said conveyance and notified Ms. Holtz by
letter that she was ineligible for deferment and that all accumulated principal and interest was due and
payable;and
WHEREAS, Ms. Holtz indicated she was unaware of the assessment when she took ownership of the
property in 2000, and that she would have paid it in full had the City informed her of the assessment at that
time; now, therefore be it
RESOLVED, that the proper City officials are hereby authorized and directed to recalculate the total interest
due on deferred assessment Project No. 0539 (Grade, Pave, Lights) for 1858 Bayard Avenue to an amount
accrued between the date of deferment on September 5, 1991 and the date of transfer of ownership to Jan L.
Holtz, on May 26, 2000; and be it further
RESOLVED, that said reduction of interest is contingent upon payment to the City of the original defened
principal ($1,250.42) and accrued interest to May 26, 2000 ($817.98), for a total of $2,068.40, by September
30, 2005.

In 1991 the previous owner of 1858 Bayazd Avenue was granted a deferment of the assessment. In 20�0 his daughter took title to the ;
property, but was unawaze of the assessment because he did not tell her and no title seazch was done to reveal iu existence. The ;
daughter claims she would have paid in full when she acquired the property. She is seeking forgiveness of accumulated interest from �
2000 to the present. The City accepts the owner's contention and recommends forgiveness of the interest, I

The property owner will save interest costs, which would not have accumulated had the owner known about and paid off the
assessment when she took over the property in 2000.

To Whom It May Concern:
The property at 1858 Bayard Avenue (property id 09.28.23.34.0047) obtained a Senior Citizens
Deferment for street work done in 1991.
Mr. Holtz was ill at the time and requested the deferment. Subsequent{y he either forgot about
the assessment or failed to tell
Jan Leslie Noltz (his daughter) about the assessment. The house was changed over to Jan
Leslie Holtz i� 1999 due to the
profonged illness of her father. When Mr. Holtz passed away in 2��1, there was no record of the
special assessment and
it was not untif 2005 that she became aware of the assessment after receiving a letter from the
city.
We would Iike to have the interest reduced to the amount that was due in 1999 when the house
changed hands.
