WHEREAS, the State of Minnesota Department of Highways.
desires to acquire a 10 -foot easement on certain property
now comprising the Adams School Playground,and the title to
said property presently is in the name of the City of Saint Paul;
now, therefore, be it
RESOLVED, by the Council of the City of Saint Paul, that
the proper City officers are herewith authorized and directed
to execute a slope easement relative to this property, a copy
of which easement is attached hereto and incorporated herein
by reference. I

SLOPE EASEMENT -'
City of Saint Paul, a Municipal corporation under the laws of the State of
Minnesota, Grantor, for and in consideration of the covenants hereinafter contained
and the sum of Four Hundred Fifty and No% nn Dollars ($ 450.00 ),

receipt of,which is hereby acknowledged, hereby grants to the State of Minnesota for
a period of time2•terminating December 1, 1970 or on such earlier date upon which the
Commissioner of Highways g ways determ,jes'by formal order that it is no longer needed for
highway purposes, the right to construct a slope on and remove materials from all that -
part of the following described (property in Ramsey County, Minnesota, &s a part of the"
general plan of improvement and protection of Trunk Highway No. 35E:
1. Lot 11, Block 2, Gage and Whitney's Addition to St. Paul, according to
the duly recorded plat thereof situate in Ramsey County, Minnesota, the_
tltld: thereto being registered and evidenced by Certificate of Title
No. 42297; +
2. Lots 6, 79 89 9 and 10,`Block 21 Gage and Whitney's Addition to the City
of St. Paul, according to the plat thereof on file and of record in the
office of the Register of Deeds in and for Ramsey County;
which lies westerly of a line run parallel with and distant 10 feet east of the west line
of said Block 2.

Grantor is the owner of the above described premises and has the lawful right
and authority to convey and grantithe slope easement herein described.
It is agreed, and the right is hereby given, that all earth or other material
{
excavated from said premises in the construction of said slopes shall become the property
of the State to be removed, or used in the construction of Trunk Highway No. 35E, or
otherwise disposed of as the State may deem fit. The State may, for the protection of

said slopes, at its option, seed or sod same.
Grantor, for itself, itslsuccessors and assigns, hereby releases the State of
Minnesota, its officers and agents, successors and assigns, from any and all liability

and claims for damages to said premises and grantor's adjoining premises, that result

_ or may result from the construction of said slope easement and all work in connection'
- therewith.
