OFFICE OF THE CITY CLERK C UNCIL RESOLUTION — GENERAL FORM PRESENTED BY COMMISSIONER DATE ^ I - 1 RESOLVED, That authority is hereby given to the Department of Libraries, Auditorium, and Civic Buildings and the Bureau of Civil Defense to enter into an agreement, a copy of which is attached, by the terms of which said Bureau shall occupy a por -_ tion of the MunicipallStadium Building for a period not to exceed three years, said space utilization to be paid for by said Bureau upon presentation of a space utilization charge by said Department, said charge to be paid for from Fund No. 0025 -241 (Rental - Building and Office Space) . 1 I Corporation COUNCILMEN Yeas Nays Carlson Dalglish Holland Meredith Petersen Tedesco Mr. President, Byrne SEP 81966, Adopted by the Council 19— SEP 81966 proved 19_ In Favor 1 ' a Mayor Against P90LISHED SEP 10 1966 22 r _ 23®U6 A G R E E M E N T THIS AGREEMENT, Made and entered into this day 1 of .1966, by and between the Department of Libraries, Auditorium, and Civic Buildings of the City of Saint Paul, hereinafterj I referred to as the "Department ", party of the first part, and the Bureau of Civil Defense of the City of Saint Paul, hereinaf I ter referred to as the "Bureau ", party of the second part, WITNESSETH: I 1. That the Department, pursuant to authority of the Charter of the City of;Saint Paul, has under its supervision, jurisdiction and control the Municipal Stadium located at 1 1000 Snelling Avenue North in said City; that contained in said 1 Stadium are those areas hereinafter call the "Premises ", which i { are described, for the purposes of this Agreement, as follows: Rooms 25 to 35; inclusive, and Rooms 37, 38 and 45, and 200 squarelfeet of storage space in Room 58, constituting 21,700 square feet of usable office space, more on less; together with the basement area below said office space, containing 2,400 square feet of area, more or less; and I 2. The Bureau is in need of office, storage and training space, which space is not available, in usable areas, in the City Hall and Court House; and for the acquisition of which said space said Bureau is willing to pay a reasonable utilization charge and is further desirous of and willing to expend available funds in improving said space) so utilized; and as further imnroved. subiect that the Premises as described, to proper authority, would suffice as of the date hereof to provide the necessary space for said Bureau; now,.therefore 1 IT IS MUTUALLY AGREED by and between the parties hereto as follows: 1 I 1. That in consideration of mutual promises and the 1 payment of a space utilization charge by said Bureau to said Department, as is hereinbelow more fully set forth, said Department agrees to allocate to said Bureau the above described Premises to be used by said Bureaulin fulfilling its responsibilities to the City of Saint Paul andithe citizens thereof. I 2. That said space utilization charge to be paid by said I Bureau to said Department shall be Five Hundred Dollars ($500.00) per month, totalling Six Thousand Dollars ($6,000.00) per annum, payable quarterly. 3. That utiliz I ation of said space by said Bureau shall commence on the first lday of May, 1966, and shall continue for a period of three (3) years from and after said date; that said period of three (3) years may be ext9nded, subject to approval of the Council of said City and upon written consent of the parties hereto. 4. That said space utilization charge shall include, amoung other things, but not be limited to: I a. Daily cleaning of floors, ash trays and 1 _ wastebaskets; I b. Hand towels, soap, toilettissue and replacement of lightslin installed fixtures; 0 c. Electric power, heat, and water; d. Servicing of air- conditioning units and other I normal building maintenance in relation to I installed fixtures and equipment; e. Reserved parking for twenty cars in the immediate vicinity of the office entrance; f. Snow removal and ground maintenance. 5. That said Bureau, at its own expense, and subject to the consent of said Department and the written approval of the City Architect of said City, may make such necessary alterations and I modifications in or upon said Premises as shall be necessary in consideration of the needs and responsibilities of said Bureau. I 6. Nothing herein contained shall be construed as trans- { ferring to said Bureau the control, management or responsibility of said Municipal Stadium, save as is herein expressly set forth; it is expressly further f agreed that this written Agreement shall I 1 constitute the entire agreement by and between the parties hereto.
