Marshall City Clerk Building Dear Sir: This is written in response to the Appeal of Leslie M. Nelson to construct an apartment building on land classified as "B" Resi- dence. The property is on the south side of Isabel Street I between Hall Ave. and Wabasha Street described as Lot 1, 2, and 3, Oak Terrace and that part of vacated alley accuring to Lot 2. This matter was considered at the August 4, 1966 Board of Zoning meeting. The appellant is appealing under Chapter 64.03, sec. 1, par 2, wherein an apartment building for more than four families may be constructed onla tract of land embracing three platted lots or equivalent area immediately adjoining a Commercial district. The surrounding zoning is as follows: adjacent and to the East, Commercial; to the West and North, "B" Residence; and to the South, "B" and "C" Residence The property is level except for the easterly part which drops steeply to Wabasha Street. The property varies about 15 to 30�feet above the grade of adjacent Isabel Street. It was the findings of the Board that it would be reasonable to grant the Appeal since the topography of the site precludes devel- opment with single - family - dwellings and since the use would have no detrimental effect on the adjacent property. The legal description of the property is Lots 1, 2, and 3, Oak Terrace Subdivision and that part of vacated alley accruing to Lot 2. This property lies on the south side of Isabel Street between Hall and Wabasha. It is presently used for a large, single - family 20 -room residence.
