RESOLVED, upon the pertinent appeal under the-Zoning
Code by Sylvester S. Davis, as owner of the subject property
situate in the City of Saint Paul, described as Lot 5, Block
2, Holcombe-Is Addition to Saint Paul located on the south
side of Marshall. Avenue��between St. Ilbans and Grotto Streets,
that the provisions of said Zoning Code hereby are determined
and varied in application so that the premises may contain
separate accommodations for several, not in excess of three
families, provided that the continuance of such three - family
dwelling be for the remaining life of the structure now on
said premises, and provided further, that the appellant comply
with the changes, set forth in the Bureau of Public Buildings
and Housing Code Division report dated July 81 1966, and
provided further that such permission shall lapse ipso facto
unless the appellant islin full compliance with the above
report dated July 8, 1966, within one year from the date of
this resolution, and provided further that the appellant
provide ,a total of three off- street parking spaces for said
dwelling, acceptance of this resolution and terms to be made
by the appellant , and subject to'complianee with said
v provisions. the Council expressly finds that such relief will be
consistent with the public health and general welfare, and that
said relief and permission herein granted is subject to the
further condition that the appellant and his successors and
assigns otherwise•shall� make due compliance with all applicable
provisions of MunicipallOrdinances State statutes, and rules
and regulations of public authorities having cognizance; further,
that a copy of this Resolution be filed with --the Register of
Deeds in and for RamseyjCounty, Minnesota. -

Dear Sir:
This is written in response to the Appeal of Sylvester S. Davis
to legalize and continue an existing, illegal three - family use on
property classified as a "B" Residence district. The property is
on the south side of Marshall Avenue between St. Albans and Grotto
Streets and is described as Lot 5, Block 2, Holcombe's Addition.
In 1894 the existing structure was constructed with a ground area
delineated by its foundation of 1,49 square feet. At some later
date, the structure was extended�without authorization to a three -
plex. Because the property is classified as "B" Residence which
would restrict it to a two- family�1use, the applicant must secure
Council authorization under Chapter 64.03, sec. 0, par 2, of the
Legislative Zoning Code to continue the three - family use.
The Board of Zoning heard this request on July 21, 1966 and it
was the Board's finding that it would be reasonable to permit the
three - family use to continue for th6 remaining life of the
structure provided the applicant complies with the changes as set
forth in the Bureau of Public Buildings and Housing Code division
report dated July 8, 1966, a copy of which is attached, and
further provided that the three existing off -street parking
spaces be maintained on the property, It is also the Board of
Zoning's recommendation that should the Council grant the Appeal,
a copy of the resolution be filed with the deed to said property
in the office of the Register of Deeds.

RE: Appeal for authorization of 'a three -plex in a "B" residential
district at 694 Marshall Avenue

The following is a list of items requiring alteration, repair or
removal to meet the minimum requirements of the Housing Code and the
Building Code.
I - BASEMENT.
a) Enclose boiler room ith construction having at least a one
hour fire rating.
b) Install a new cover on the water meter hole in the basement
floor.
c) Install handrail in the basement stairway.
d) Install an approved elief valve on the hot water heater.

e) Replace the flexible connector supplying the gas to the
heater with material that meets the Code requirements.
f) Install a new trap of the laundry tub,. complete with a vent.
g) Provide the proper plug in the soil stack where the opening
is presently cemented', shut.
h) Install a proper connection in the soil stack where presently
an 1/'q" waste line -has been installed.
i) Remove the BX, Romex and greenfield wiring systems used in
the basement and replace with wiring that meets the Code
requirements.
J) Also remove the wiring that has been added to the burner
circuit and have it. wired on its own individual circuits.
II - FIRST FLOOR.
a) Repair the plastered walls and ceiling tile in Apt. #1,
and replace the broken sash cords in the bathroom.
h) Repair or replace faulty light fixture in the first floor
bathroom and in the front and back bedrooms.
i) Repair the faulty light fixture and switch on the stairway
lighting.
j) Install a wall receptacle in the bathroom.
III - SECOND FLOOR. I

Install a gas stop on the kitchen range and re- install the
vent'on the second floor bathroom wash basin.
g)
Unit. #3 -- Replace broken sash cords in the bathroom.
h)

J) The Housing Code inspectors indicated the housekeeping in
this unit was found to be extremely poor and they insist
the tenant be advised by the property owner that such
practices must cease immediately.
IV - GENERAL STRUCTURE
a) Repair the lattice work on the, east side of the front porch.
b) Refasten the downspouts where needed..
