Resolved, That upon the petition of
the Housing and Redevelopment
Authority those sections of public
streets hereinafter described be and
the same hereby are vacated and dis-
continued as public streets:
Iglehart Avenue from the easterly
right of way line of Virginia Street
to the easterly right of way line
of Western Avenue and from a
line five feet westerly and parallel
to the westerly right of way line
of Western Avenue to the easterly
right of way line of Arundel Street;
Virginia Street from the northerly
right of way line of Marshall Ave-
nue to the southerly right of way
line of Carroll Avenue; Farrington
Street from the northerly right of
way line of Marshall Avenue to
the northerly right of way line of
Marshall Place; and Marshall Place.
from the east property line of Lot
28, Block 83, Dayton do Irvine's
Addition to Saint Paul, extended
northerly to the easterly right of
„ way line of Virginia Street;
subject expressly 'to the following
conditions and reservations:
1. That the streets to be vacated be
described as indicated in the
petition and referenced above.
2. That the vacation be subject to
all the terms and conditions of
Section 228 of the Legislative Code.
3. That specific sewer easements be
retained in the following streets:
Iglehart Avenue from Western
Avenue to Arundel Street.
Virginia Street from Marshall
Avenue to Carroll Avenue.
4. That specific easements, being 30
feet wide, 15 feet on either side of
the existing water mains, be re-
tained in Virginia Street between
Iglehart- and Marshall Avenues and
in Iglehart Avenue between
Arundel' Street and Virginia Street
to protect the interests of the
Water Department, easements .to'.
provide that the present grade over
these areas is to be maintained and
no buildings are to be constructed
within the easemeen�t area.
5. That specific =%ents be main-
tained in Marshall Place, Farring-
ton, and Virginia Avenues to the
extent shown on the attached plan
(Exhibit A) to protect the interests
of Northwestern Bell Telephone
Company.
6. That specific easements be retained
in all of the streets to be, vacated
to protect the interests of the
Northern States Power Company in
regard to their existing gas and
electric installations.
7. That the petitioner erect barricades
or proper signing and partial bar-
ricades on all vacated street areas
as will be designated by the De-
partment of Public Works with the
stipulation that the plans for
barricades and signs be referred
to the officials of St. Joseph's
Academy for information and com-
ment. The signs and barricades
shall be erected and placed to the
satisfaction of the Department of
Public Works and the Fire
Department.
8. That the petitioner give, or cause
to be given, proper notification to
both the Police and Fire Depart-
ments prior to the closing or
barricading of any streets described
herein so that adequate provisions
f5r access to the existing buildings
for emergency purposes can be
maintained.
9.That the filing fees for recording
the vacations in• the office of -the
Register of Deeds be borne by the

10. That the petitioner, being the
Housing and Redevelopment
Authority, a public agency, not be
required to pay a compensation for
the vacation because of the in-
tended dedication of lands for
widening of Western Avenue as
provided for by City Council Res-
olution C.F. No. 214859 approved
September 25, 1963, and the co-
operative agreement between the
City and the Authority dated
November 25, 1963.
11. That" in lieu of a bond the City
of St. Paul be provided with a
written covenant iconditioned to in-
demnify and hold the City harm-
less from any and all damages,
claim for damages, costs, charges,
