WHEREAS, The City of Saint Paul has heretofore indicated
its opposition to the merger petition of the Northern Pacific
Railway Company, The Great Northern Railway Company, the Chicago,
Burlington, and Quincy Railway Company, and the S69ttle, Portland
and Spokane Railway Company, by.,Cpuncil File 205095 adopted
December 8, 1961; and
WHEREAS, The Corporation,Counsel was directed to intervene
in opposition to said merger; and
WHEREAS, The Interstate Commerce Commission, on April 27,
1966, denied the petition of the foregoing railroads to merge; and
WHEREAS, The above railroads have again petitioned the
Interstate Commerce Commission for reconsideration; now, therefore,
be it

RESOLVED, That the City of Saint Paul give notice of its
continued opposition to this merger and reaffirm the resolution'
of December 8, 1961; and be it
FURTHER RESOLVED, That the City Clerk is hereby authorized
and directed to forward a certified copy'of this resolution and
resolution, Council File 205095, to each member of the Interstate
Commerce Commission, to the United States Senators of the State
of Minnesota, and the-Represent'atives of the State of Minnesota,
the Governor of the State of Minnesota, and the Railroad and
Warehouse Commission of the State, of Minnesota.

Dear Mr. Marshall:
I appreciated'receiving copy of the resolution of
the St. Louis County Board of Commissioners opposing merger
of the Great Northern, Northern Pacific, Chicago Burlington
and Quincy, and the Spokane
and and Seattle Railroads,
and am grateful for the Board's forthright expression of
opinion on this important matter.
I have been staying 'closely in touch with the Interstate
Commerce Commission on this,case ever since its inception,
and particularly since the filing of the new petition by
the Great Northern. The latest information is that the ICC
has the petition before it, and is giving it serious consideration;
and inasmuch as the Commission has not yet issued its
further findings in the case; it would be inappropriate to
comment on the matter at thel present time. However, as.;
soon as I have received further information, I will be in touch
with you again.

resolution adopted by the City of Saint Paul regarding
the petition for reansideration of the I.C.C. decision
on the Great Northern- Northern Pacific merger applic-
ation. ;}
As you know, the Interstate Commerce Commission
is a quasi - judicial body and =members of Congress have no
authority to intervene 1n matters brought before it for
consideration. However'; I have been informed by the I.C.C.
. I
that the time for filing replies to the petition for
reconsideration has been extended to October 25, and I
appreciate having a statement of position on this matter
by the City Council. ;
