Anderson, as owner of the subject property situate in the City of Saint Paul described as Lot "A" and the northerly 40 feet of Lot 9, I &lmont" Addition to the City of St. Paul, located on the east side of Eichenwald Street between East Sixth and East Seventh Streets, that the provisions of said Zoning Code hereby are determined and varied in application so that the premises may contain separate accommoda- tions for several, not in excess of four families, provided that the continuance of such four- family dwelling be for the remaining life of the structure now on said premises, and provided further, that the appellant comply with the changes set forth in the Bureau of Public Buildings and Housing Code Division report dated August 9, 1966, and provided further, that such permission shall lapse ipso facto unless the appellant is,in full compliance with the above report, dated August 9, 1966, within one year from the date of this resolution, and provided further, that the appellant provide a total of four- off - street parking spaces for,sakd dwelling, acceptance of this resolution and terms to be made by the appellant, and subject to compliance with said provisions the Council expressly finds that such relief will be consisteAt with the public health and general welfare, and that said relief and permission - herein granted is subject to the further condition that the appellant and his successors and assigns otherwise shall make due compliance with all applicable provisions of Municipal - Ordinances, State Statutes, rules and regulations of public authorities having cognizance; further, that a dopy of this Resolution be filed with the Register of Deeds in and for Ramsey County, Minnesota. Marshall City Clerk Building Dear Sir: This is written in response to the Appeal of Mervin C. Anderson to legalize and continue an existing illegal four - family use on property classified in a "B" Residence district. The property is on the east side of Eichenwald Street between East Sixth and East Seventh Streets and is described as Lot "A" and the north- erly 40 feet of Lot 9, Belmont Addition. In 1901 the existing structure was constructed with a ground area delineated by its foundation of 1,106 square feet. At some later date the structure was extended without authoriza- tion to a four -plex. Because the property is classified as "B" Residence, which would restrict it to a two - family use, the applicant must secure Council authorization under Chapter 64.03, sec. o, par. 2 of the Legislative Zoning Code to continue the four - family use. The Board of Zoning heard this request on July 21, 1966. It was the Board's findings that it would be reasonable to permit the four - family use to continue for the remaining life of the struc- ture provided that the applicant comply with the changes asset forth in the Bureau of Public Buildings and Housing Code Divi- sion report dated August 9, 1966,, a copy of which is attached, and further provided that four off -street parking spaces are developed on the property. It is, also the Board of Zoning's recommendation that, should the Council grant the Appeal, a copy of the resolution be filed with the deed to said property in the office of•the Register of Deeds.- Very truly yours, NRH /mm N. Seventh Street The following is a list of items requiring alteration, repair or re- moval to meet the minimum requirements of the Housing Code and Building Code: 1. The attached garage must have the walls and ceilings covered with material to give it a,-one hour fire rating. 2. The furnace room must be separated from the rest of the base- ment with materials having -a one hour fire rating. 3. All the downspouts from the rain gutters must be connected to the sewer. 4. The doors presently separating one apartment from another and those doors from the apartment to the hallway must be �c'hanged so they have at least a one hour fire rating, 5. Off street parking must be provided for at least four cars. 6. A handrail must be installed in the basement stairway. 7. An incinerator or garage disposal unit must be installed in all the kitchen sinks. 8. The kitchen sink waste in Apt. #4 must be provided with a vent. 9. • r A proper gas cock must be installed on the gas range connec -' tion. ZONING FILE �//3 Y g� R The work we have recorded consisted of` installing an outside entrance leading to a new doorway providing a private entrance to the second floor rear apartment. No permit was issued for alterations in the re- locating partitions within the areas for dividing up a porch area into bedrooms or for electrical work performed in Apt. ##4. It will be necessary that permits be secured for the above mentioned work. A handrail must be installed on the' steps leading from the private to the public walk. 13. A warning tag must be installed on the line to the expan- sion tank for the hot water; heating system. A proper type of safety valve must be installed on the heating plant.. r Our inspectors have reported the building is presently being occupied as a three unit building; however, all facilities are there for four units: They have also reported in 1965 alterations were made to convert the building from a single family to a four unit building. Some of the work was performed without permits being issued.
