In the matter of condemning and taking an easement in the land
necessary for slopes, cuts and fills, including the right of removal
of lateral support from subject land or remainder thereof, occasioned
by excavations thereof or construction of slopes in the grading and
surfacing with bituminous material 5WRTH STREET from Clarence Street
east to and including the cul -de -sac, under Preliminary Order 228091,
approved April 13, 1966, Intermediary Order 2291779 approved June 21,
1966 and Final Order No. 2295209 amended to read:
"Resolved Wy the Council of the City of St. Paul that the
precise nature, extent and kind of improvement to be made
by the said City is condemning and taking an easement in bhe
land necessary for slopes, cuts and fills, including right of
removal of lateral support from subject land or remainder thereof,
occasioned by excavations thereof or construction of slopes in
the grading and surfacing with bituminous material FOURTH STREET
from the east line of Clarence Street east to a point approximately
165 feet"
on July 19, 1966.
RESOLVED FURTHER, That the above order be AMENDED to read:
"Resolved, by the Council of the City of St. Paul that the
precise nature extent and kind of improvement to be made by
the said City is condemning and taking an easement in the
land necessary for slopes, cuts and fills, including the
right of removal of lateral support from subject land or
remainder thereof, occasioned by excavations thereof or
` construction of slopes in the grading and surfacing with
r bituminous material FOURTH STREET from the east line of
Clarence Street east to the east line'of Lot 9, Stenlund's
Sub"
