These criteria are covered below under "Required Findings." HISTORY/DISCUSSION: In 2003, the parcel was rezoned from RT2 and 11 to RM2. On March 14, 2005, the Board of Zoning Appeals granted the applicant variances for a front yard setback of 4.5 feet, a north side yard setback of 9 feet and a separation between buiidings of 10 feet. DISTRICT COUNCIL RECOMMENDATION: The District 5 Community Economic Development Committee strongty supports the platting and future development ofi Payne Avenue Townhomes Second Addition. REQUIRED FINDINGS: § 69.406 of the Zoning Code requires that all of the foilowing findings shall be made prior to approval of a subdivision: 1. All the applicable provisions of fhe Legislative Code are complied with. This condition is met. City staff have reviewed the proposed plat and have determined that all applicable provisions of city codes are met. 2. The proposed subdivision will not be detrimenta! to the present and potential surrounding land uses. This condition is met. The proposed plat development as townhomes gives an appropriate edge to Swede Hoilow Park and is compatibie with housing to the north and south of the site. This development will not be detrimenta� to present or future use of surrounding land. 3. The area surrounding the subdivision can be planned and developed in coordination and compatibility with the proposed subdivision. This condition is met. The property in question cannot be put to a reasonable use under the strict provisions of the code. - This project is the final phase of a lazger development that wiil eventually include three 8- unit townhouses. The first townhouse structure built in 2003 was granted front and reaz setback variances. These structures will have similaz front setbacks but does not require a reaz setback variance. The applicant has been designated the developer for this project. The applicant has been working with the City, the District Community Council, and other interested parties in creating this project. The proposed design is based upon input received during this process. The requested variances stem &om the desire to have the buildings located ciose to the street with the parldng at the reaz and to accommodate a storm water holding pond. The proposed townhouses are a reasonable and pemritted use for this properry that cannot be accommodated under the strict provisions of the code. 2. The plight of the Zand owner is due to circumstances unique to this property, and these circumstances were not created by the Zand owner. This portion of Payne Avenue is a unique area with mixed commerciai and residential buildings and uses side by side. The existing buildings are typically built close to the street. In order to maintain this street presence it is necessary to reduce the required front setback. This is a circuxnstance that was not created by the property owner. 3. The proposed variance is in keeping with the spirit and intent of the code, and is consistent with the health, safety, comfort, morals and welfare of the inhabitants ofthe City ofSt. Paul.
