RESOLVED, upon the pertinent appeal under the Zoning
Code by Eugene Yorga, as owner of the subject property situate
in the City of Saint Paul, described as the West 30 feet of Lot
13 and the Easterly one -half of Lot 14, Block 2, Bryant's Addition
to St. Paul, located on the south side of Ashland Avenue between
Avon and Victoria Streets, that the provisions of said Zoning Code
hereby are determined and varied in application so that the
premises may contain separate accommodations for several, not in
excess of four families, provided that the continuance of such
four - family dwelling be for the remaining life of the structure
now on said premises, and provided further, that the appellant
comply with the changes set forth in the Bureau of Public Buildings
and Housing Code Division report dated December 16, 1965, and
provided further, that such permission shall lapse ipso facto
unless the appellant is in full compliance with the above report,
dated December 16 , 1965, within one year from the date of this
resolution, and provided further, that the appellant provide a
total of four off - street parking spaces for said dwelling, accept-
ance of this resolution and terms to be made by the appellant,,,
and subject to compliance with said provisions the Council
expressly finds that such relief will be consistent with the
public health and general welfare, and that said relief and
permission herein granted is subject to the further condition
that the appellant and his successors and assigns otherwise
shall make due compliance with all applicable provisions of
Municipal Ordinances; State Statutes, rules and regulations of
public authorities having cognizance; further that a copy of
this Resolution be filed with the Register of Deeds in and for
Ramsey County, Minnesota.

This is written in response to the�appeal'of Eugene Yorga to legalize
and continue an existing illegal four family use on property classi-
fied as "B" Residence., The property is located on the south side of
Ashland Avenue between Avon and Victoria Streets and is described as
the West 30 feet of Lot 13 and the Easterly 1/2 of..Lot 14, Block 2,
Bryant's Addition.
In 1909 the existing structure was e, constructed with a ground area
delineated by its foundation of 1,062 square feet. At some later date
the structure was extended without authorization to a'four -plex.
Because the property is classified as "B ",Residence, which would
restrict it to a two - family use, the applicant must secure Council
authorization under Chapter 64:03., sec. o, par. 2'of -the Legislative
Zoning Code to continue the four- family use.''
The Board of Zoning heard this request on January 6, 1966. It was the
Board's findings, that it would be'reasonable to permit the four - family
use 'to - eontniie for the remaining' life of the structure provided that
the applicant comply with the changes,'as set forth in the Bureau of
Public Buildings and Housing Code Division-,report dated December 16,
1965, a copy of which is attached, and further provided that four off -
street parking spaces are developed on'the property. It is also the
Board of Zoning's recommendation that, should the Council grant the
appeal, a copy of the resolution be-filed with the deed to said
property in the office ofFthe Register of-Deeds.

I. Eugene E. Yorga, of 852 Ashland Avenue, St. Paul, Minnesota,
hereby appeal for authorization to continue the multiple occu-
pancy of my home at 852 Ashland Avenue.
This building which I am now purchasing is being used by me as
my place of residence together with three apartments now occu-
pied by tenants. I propose to continue the use of said premises
as a multiple dwelling until my mortgage is paid off and until
I will have need for portions of this building for my own family
use.
It is necessary that this appeal be granted as I am purchasing
these premises on a Contract for Deed subject to a mortgage and
the income received from the rental of the apartments together
with my own contribution is barely enough to meet my monthly
payments, pay the taxes and cost of maintenance. Should my
appeal be denied, I would not have enough income to make my
monthly payments and would lose the equity which I now have in
the premises, r
This appeal is being taken under Legislative Code Chapter 64.03
Section 0, Paragraph 2 and it is respectively requested that this
appeal be favorably acted upon by you.
Submitted herewith is my check for $20 payable to the City of
Saint Paul as the appeal fee.
