Green Sheet # 3027599 m Presented By RESOLUTION CITY OF SAINT PAUL, MINNESOTA Referred To ° \..� Committee: Date August 4, 2005 1 WHEREAS, Neighborhood Housing and Property Improvement (NHPI) has requested the City 2 Council to hold public hearings to consider the advisability of revoking the rental registration certificate 3 for a duplex rental properiy located at 823 AURORA AVE and registered to Lawrence and Arveria 4 Walker; and 6 WHEREAS, on May 17, 2005, NHPI conducted an inspection of said property and issued a 7 Summary Abatement Order with a compliance deadline of May 27, 2005; and 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 WHEREAS, on May 28, 2005, NHPI conducted a reinspection of said property and found lack of compliance with the previous order; and WHEREAS, on June 1, 2005, NHPI sent the holder ofthe rental registration certificate for the subject property, Lawrence and Arveria Walker, a$50 excessive consuxnption bill, addressed to 629 St Anthony Ave, St Paul MN 55104-4846, the address on said certificate; and WHEREAS, as of August 4, 2005, said $50.00 t�as not been paid, and Legislative Code §51.06 (a) (v) provides that non-payment of fees for excessive consumption is grounds for certificate revocation; and WHEREAS, on June 1, 2005, NHPI notified Lawrence and Arveria Walker ofthe need to arrange an interior inspection ofthe subject property, and WHEREAS, as ofAugust 4, 2005, an interior inspection has not been arranged, and Legislative Code §51.07 (a) (iii) provides that the irnposition of an excessive consumption fee is grounds for an interior inspection; and WHEREAS, on July 20, 2005, NHPI sent Lawrence and Arveria Walker the proper Notice of Intent to Revoke Rental Registration (copy attached); and WHEREAS, Lawrence and Arveria Walker has not appealed said notice and the time for filing an appeal has expired; now therefore BE IT RESOLVED, that based on the foregoing, the Saint Paul City Council hereby adopts the following findings and order conceinnig the subject properiy at 823 AURORA AVE . That said certificate holder has been billed for excessive consumption of code inspection services, wlrich has not been paid. That said certificate holder has been requested to allow an interior inspection of the subject properiy, which l�as not been arranged. That the notification requirements of Chapter 51 have been fulfilled and the time for an appeal has expired without an appeal being made. •�� • The Saint Paul City Council hereby makes the following order: 1. The above-referenced Rental Registration Certificate issued to Lawrence and Arveria Walker for the duplex rental property at 823 AURORA AVE, Saint Paul, MN is hereby revoked. 2. You are hereby notified, pursuant to the authority granted to me under Chapter 51 of the St. Paul Legislative Code, of the City's intent to revoke the registration certificate for 823 AURORA AVE based on the following: On May 17, 2005, this department conducted an inspection of said property and issued a Summary Abatement Order with a compliance deadline of May 27, 2005. 2. 3. 4. 5. 6. On June 1, 2005, this department notified you by maIl of the need to arrange an interior inspection of said rental property. As of today this interior inspection has not been arranged. I have referred this matter to the St. Paul City Council with a recommendation to revoke the rental registration certificate. The City Council will revoke unless an appeal is filed in the next thirteen (13) days from the date of this notice. An appeal may be filed pursuant to legislative Code §18.02, by appearing in person between the hours of 8:00 a.m and 4:30 p.m on any business day at the City Clerk's Office, Room 170, City Hall, 15 W. Kellogg Boulevard, St. Paul, MN or you may appeal by mail within the same 13 day time line. Note: Renting a property without a certificate is a misdemeanor. Please call me as soon as possible to arrange a meeting to discuss how to correct this situation before the City Councii acts to revoke this certificate. Ifall issues are addressed, I will recommend that the revocation be withdrawn from consideration by the City Council.
