Gerber City Clerk Building Dear Sir: This is written in response to the appeal of Ja1;.cha S. and Rose B. Nemer to relax the density standard in order to construct a 40 -unit apartment building on property located in a bight and Heavy Industry district. This is also written in response to the application for a permit to con- struct a 57 -car parking facility on said property. The property is located on the east side of Cleveland Avenue between Villard Avenue and the Ford Motor Company railroad spur track, described as except that part taken for Cleveland Avenue that part of the northwest 1/4 of the south- west 1/4 of Section 16, T. 28, R. 23, bounded as follows: on the South by a line 100 feet North of and parallel with the North Line of Villard Ave.; on the West by the center line of Cleveland Ave.; on the North by the Southerly line of the 140 foot railroad R -O -W; on the East by a line 150 feet East of and parallel with the East line of said Cleveland Avenue. At the January 6, 1966 Board of Zoning meeting, the staff reported the following surrounding uses: North, the railroad spur; East, single - family residences; South, a grocery store; and West,'apartments. The surrounding zoning is as follows: North, "A" Residence and Heavy Industry; East, Light Industry; South and West, Commercial and Heavy Industry— The area requirements for a 40 -unit apartment is 40,200 square feet and, since the area of the property is 35,100 square feet, there is a defi- ciency in area of approximately 5,100 square feet. It was the findings of the Board that the proposed 40 -unit apartment would be the best use of the property since an industrial use, which would be undesirable in this location, could be developed on the property. Therefore, the Board recommends approval of the appeal to relax the density standard on the property. This is more than ample off - street parking for the tenants and their guests, and this construction will not cause any increase in street parking. The proposed plans will establish that there will be ample on- site driveways and ramps leading from the street into the underground garage. Further, the proposed construction as depicted in the plans will show this to be a luxury type apartment building, each unit of which will contain a minimum of 1175 square feet. We also submit that it would not be economically sound for the owners to construct a 35-unit apartment building on this particular site of the type proposed and that this building will be a valuable addition to the community. In view, of the fact that the increase of five units over the maximum provided by the ordinance will not cause any additional street parking, and that each apartment will be most spacious and roomy and without the crowding, of too many units per floor, we respectfully submit that this application should be granted.
