WHEREAS, Erwin Weiss, an employee of the Department of
Public Works, was injured in a third party accident on January 27,
1965, while engaged in the performance of his duties; and ; <;
WHEREAS, the City has incurred medical expense in the
amount of $72.50 therefor; and
WHEREAS, a settlement has been negotiated between said
employee and the other party involved in said accident, out of
which the City will receive the full amount of its subrogation
interest by reason of injury to its employee, $72.509 less one -
fourth as attorneys fees, $18.13, or a'net settlement to the City
of $54.37, now, therefore, be it
RESOLVED, That the proper City Officers are hereby
authorized to accept and endorse the check of Kelly, Segell 6
Fallon in the amount of $72.50, to accept from said sum the amount
of $54.37, to be credited to the Workmen's Compensation Fund; to
issue the City's draft for the remaining $18.13 payable to Kelly, Segell 8
Fallon, attorneys for Erwin Weiss, and to execute any necessary releases
therefor.
