RESOLVED, upon the pertinent appeal under the Zoning
Code by David R. Johnson, as owner of the subject property
situate in the City of Saint Paul, described as Lot 8, Blo:c.k 3,
"Van Slyke & Lewis" rearrangement of Humbirds Addition to St.
Paul, located on the northeast corner of Arkwright Street and
Jessamine Avenue, that the provisions of said Zoning Code hereby
are determined and varied in application so that the premises
may contain separate accommodations for several, not in excess
of three families, provided that the continuance of such three -
family dwelling be for the remaining life of the structure now
on said premises, and provided further, that the appellant comply
with the changes set forth in the Bureau of Public Buildings and
Housing Code Division report dated December 22, 1965, and
provided further, that such permission shall lapse ipso facto
unless the appellant is in full compliance with the above report,
dated December 22, 1965, within one year from the date of this
resolution, and provided further, that the appellant provide a
total of three off- street parking spaces for said dwelling,
acceptance of this resolution and terms to be made by the
appellant, and subject to compliance with said provisions the
Council expressly finds that such relief will be consistent
with the" public health and general welfare,' and that said relief
and permission herein granted is subject to the further condition
that the appellant and his successors and assigns otherwise
shall make due compliance with all applicable provisions of
Municipal Ordinances, State Statutes, rules and regulations of
public authorities having cognizance; further, that a copy of
this Resolution be filed with the Register of Deeds in and for
Ramsey County, Minnesota.

Dear Sir:
This is written in response to the appeal of David R. Johnson to
legalize and continue an- existing illegal three- family use on
property classified as "B" Residence. The property is located on-
the northeast corner of Arkwright Street ^and Jessamine Avenue,
described as Lot 8, Block 3, Van Slyke and Lewis Rearrangement of
Humbird's Addition.
In 1887 the existing structure was constructed with•a ground area
delineated by its foundation of'1,066 square feet. _ At some later
date, the structure was extended without authorization to a three -
plex. Because the property is classified- as, "B" Residence which
would restrict it to a two- family use., -the applicant -must secure
Council authorization under.Chapter 64.03, Section o, -par. 2 of
the Legislative Zoning Code to continue the�use of the property
as a three -plex.
The Board of Zoning heard this request on January _6, 1966. It
was the Board's finding that it would be.reasonabie to permit a
three - family use to continue for the remaining life of the struc-
ture provided that the applicant comply with the changes�as set -
forth in the Bureau of P.ublic'Buildings,and the Housing Code
Division report dated December 22, 1965, and - further provided
that three off -street parking spaces are developed on the property.
It is also the Board's recommendation that,-if the - Council grants
the appeal, a copy of the resolution be fileCwith the deed to
said property in the office of the Register of Deeds.

RE: Appeal for authorization of a three -plex occupancy in
a "B" residential district at 405 E. Jessamine
Zoning File #5477

The following is a list of items requiring alteration, repair or
removal to meet the minimum requirements of the Housing Code and
Building Code.
1. Repair the plaster throughout the building wherever it is
cracked or loose.
2. Install handrails throughout the building wherever there
is a stairwell of more than two risers. (This will in-
clude the exterior entries.)
3. Replace the materials used to close up the openings be-
tween apartments on the second floor with materials equal
to the existing.wall construction.
4. Repair the limestone foundation by repointing the mortar
joints.
5. Provide screens where they are missing.
6. Paint-the exterior trim.
7. Either rehabilitate or remove the garage at the rear of
the property.
8. Replace the broken attic'window and do whatever else is
necessary to keep the pigeons from entering.
9. Clean out the accummulation of rubbish, broken furniture,
etc., in the garage and the basement.
10. Replace the broken flush box cover.

11, Repair the peeling paper in the living room of Unit 2.
It appears that this is caused by a roof leak and if so,
the roof leak must be repaired.
12. Supply a sufficient number of garbage cans.
13. Provide new traps on the kitchen sink in the apartment
on the first.floor and also on the lavatory in the first
floor bathroom. Also install the proper vent on the
kitchen sink.
1'4'. In the front apartment on the second floor, install the
required vent in the kitchen sink and repair the leaking
faucet.
15. Install a vent on the wash basin in the bathroom.
16. Repair the gas connection on the gas space heater in
the front room and also re- install the flue pipe that
is presently sagging, causing the combustion gases to
be trapped.
17. Install a vent on the kitchen sink in the bathroom of
the rear second floor apartment.
18. Re- install the flue pipe on the space heater in the
kitchen as it is presently sagging and trapping the
combustion fumes.
19. Install the proper fuses in the electric fuse cabinets
and re- install the fuse cabinets so they are accessible
to all apartments.
20. Provide a proper receptacle for the laundry equipment.
21. Remove the BX wiring system in the basement and re -wire
so it meets the Code requirements.
22. Remove the extension cords that are in use throughout the
building.
23. Install additional outlets so there are at least one in
each bathroom, two in all other habitable rooms except
the kitchen which must have three.
24. Remove the un- approved wiring system in the storage area.
