RESOLVED, upon the pertinent appeal under the Zoning
Code by Max Bix, as owner of the subject property situate in the City
of Saint Paul, described as Lot 17, Block 3, Nininger & Donnellyts
Addition to Holcombets Addition to Saint Paul, located on the north
side of Dayton Avenue between Fisk and Victoria Streets, that the
provisions of saidZoning Code hereby are determined and varied in
application so that the premises may contain separate accommoda-
tions for several, not in excess of four families, provided that
the continuance of such four - family dwelling be for the remaining
life of the structure now on said premises, and provided further,
that the appellant comply with the changes set forth in the Bureau
of Public Buildings and Housing Code Division report dated
December 20, 1965, find provided further, that such permission shall
lapse ipso facto unless the appellant is in full compliance with
the above report, dated December 20, 1965, within one year from
the date of this resolution, and provided further, that the appellant
provide a total of four off - street parking spaces for said
dwelling, acceptance of this resolution and terms to be made
by the appellant, and subject to compliance with said provisions,
the Council expressly finds that such relief will be consistent
with the public health and general welfare, and that said relief
and permission herein granted is subject to the further condition
that the appellant and his successors and - assigns otherwise shall
make due compliance with all applicable provisions of Municipal
Ordinances, State Statutes, rules and regulations of public
authorities having cognizance• further, that a copy of this
Resolution be filed with the register of Deeds in and for Ramsey
County, Minnesota.

Dear Sir:
This -is written in response to the appeal-of Max- Bix.to legalize
and continue an existing illegal four - family use on property
classified as "B "- Residence. • The property -is located on-'the north
side of Dayton Avenue between Fisk and Victoria Streets, described
as Lot 17, Block_, 3, Nininger and Donnelly's Addition.
In 1900 the existing structure was constructed with a ground area
delineated by its foundation'of 1,134 square feet.. At some later
date, the structure was extended without authorization to a four -
plex. Because the property is "classified as "B" Residence which
would restrict it to 'a two - family use, the applicant must'secure
Council authorization under Chapter 64.03,�Section o, par 2., of
the Legislative Zoning Code to continue the four- amily use.

The Board of Zoning heard-this request on--January- , -1966. It was.-
the Board's findings ,that it would be'reasofiable to permit the
four - family use to continue for the remaining life of-the structure
provided that the applicant comply with the changes as set forth in
The Bureau of Public Buildings and the Housing Code Division report
dated December'202 1965, a copy of which is attached, and further
provided that four off - street parking spaces are developed on the
property. `
It is also the Board of Zoning's recommendation that, if the Council
grants the appeal, a copy of the resolution be filed with the deed
to the said property in the office, of the_ Register of Deeds.

Dear Sirs=
I, Max Bix, owner of the property at 837 Dayton Ave.; St. Paul, legally
described ass Lot 17, Block 3, Ninninger & Donnelly's Addition.
The general location being, onthe north side of the block between Fisk
and Victoria.
The property is presently bein-g used as income property, with one apart-
ment on the first floor and 5 housskeeping rooms on the second floor. I'pro-
pose to use the first floor as one apartment (4 rooms), and second floor (5
rooms) as 3 housekeeping units.
The need for clean, well -kept housekeeping units at a very reasonable
rental for 61dsr ind }viduals is an economic necessity and an asset to any com-
munity. Facilities must be made available for those people with a limited ino-
ome, who still want to retain a measure of independence and dignity, which is
their due, especially if they are physioaly able to care for themseves.
I understand the zoning, at present, is for not more than a duplex, and I
would like to bring it in compliance with the city zoning code under Section
64.03, section "o ", paragraph 2. _

The following is a list of items requiring alteration, repair or
removal to meet the minimum requirements of the Housing Code and
Building Codes:
The building is presently occupied with one apartment on the first
floor and five on the second. To reduce this occupancy to a four -
plex, it will require the elimination of two of the units. Since
the second floor is divided up into five apartments of only one
room each, we assume that several of these will be combined to
make larger apartments. This would result in a possibility of re-
moving several sinks and gas plates and thus reduce some of the
requested changes in our list.
1. Provide a partition and ceiling construction around the
boiler rooms having at least a one hour fire rating.
2. Install a handrail on the stairway to the basement.
3. Replace the badly cracked window pane in unit 2.
4. Install a handrail on the upper portion of the front
interior stairway.
5. Install a handrail on the upper portion of the rear in-
terior stairwell.
6.
Install
a hand
lavatory to be used in connection with the
toilet
located
on the first floor.
7.
Install
a new
connection to the range so that the connec-
tion is
made inside
the room with a shut -off valve.
8.
Install
a new
trap and required vent on the sink in Apt. 4.
9.
Install
a sink
in Apt. 6 or remove the gas plate and con-
vert the
room
to another use.

10. The chimney to which the water heater is connected to in
the basement has been cut off below the roof line. At
the present time the water heater is now venting into
the attic. The chimney construction must be extended so
as to vent the water heater directly to the outside.
11. The vents from the second floor sinks have been carried
into the attic but have been terminated and left open
into the attic. It will be necessary for these to be
extended up through the roof to the outside.
Y2:- Provide a main disconnect switch for the electric service
and re- install the correct size fusing in the branch cir-
cuits.
13. Remove the BX, loom and knob and tube wiring used in the
basement and replace with wiring that will meet the Code
requirements.
14. Install a receptacle for the use of laundry equipment in
the basement.
