Loss — Resolved, That upon the petition of Steenberg Construction Company, that section of public street hereinafter described be and the same hereby is vacated and discontinued as a public street: Hubbard Avenue from North Vic- toria Street in a westerly direction to a line produced by the northerly extension of the westerly line of Lot 19, Block 10, Winter's Addition; subject expressly to the following con- ditions and reservations: 1. That the vacation be subject to all the terms and conditions of Section 228 of the Legislative Code, as' amended, regulating the procedure and prescribing conditions for the vacation of public grounds, streets, alleys and highways in the City of Saint Paul; 2. That the portion of the street to be vacated be described as follows: that part of Hubbard Avenue between the west line of North Victoria Street and the west line of L;t 12, Block 11, Winter's Addition, ex- tended southerly, containing an area of 27,900 square feet, more or less; 3. That in exchange for this vacation the petitioner shall deed to the City for the opening, widening, and ex- tension of Pierce Butler Route the following described property: those parts of Lots 7, 8, 9, 10, 11, and 12, Block 10, Winter's Addi- tion, bounded by the following described lines: Beginning at a point, being the southeast corner of Lot,7, Block 10, Winter's Addi- tion; thence west on the south line of Lots 7, 8, and 9, of said Block 10 to the southwest corner of said. Lot 9, thence northwest- erly along a straight line to a point on the west line of Lot 12, Block 10, Winter's Addition, 45 feet distant north of the south- west corner thereof; thence southwesterly on a straight line to e point of beginning; con- taining 2,673 square feet, more or less; 4. That the property owners abutting Hubbard Avenue between Milton Street and the extended west line of Lot 12, Block 11, Winter's Addition, acquiesce to the vacation to the satisfaction of t he Corporation Counsel; 5. That the petitioners pay to the City the sum of $6,300 as compensation, for the vacation and provide the ' City with a bond in the amount of $5,000. Adopted by the Council February 4, 1966.
