RESOLVED, upon the pertinent appeal under the Zoning Code
by Dr. Charles H. Williams, as owner of the subject property situate
-in the City of Saint -Paul, described as Lot 14, Block 1, Fairbanks
,Addition to the City of St. Paul, located on the north side of
Iglehart Avenue between Milton and Victoria Streets, that the pro-
visions of said Zoning Code hereby are determined and varied in
•application so that the premises may contain separate accommodations
'for several, not in excess of three families,,provided that the con -
,tinuance of such three - family dwelling be for the remaining life of
the structure now on said premises, and provided further, that the
•appellants.,comply with the changes set forth in the Bureau of
Public Buildings and Honing Code Division report dated November 18,
1965, and provided further, that such permission shall lapse ipso
facto unless the appellant: tOV'." in full compliance with the above
report, dated November 18, 1965, within one year from the date of
'this resolution, and provided further, that the appellant provide
a total of three off-street parking spaces for said dwelling,
acceptance of this resolution and terms to be made by the
,appellant, and subject to compliance with said provisions the
Council expressly finds that such relief will be consistent with
the public health and general welfare, and that said relief and
Permission herein granted is subject to the further condition that
'the appellant and successors and assigns otherwise shall make
due compliance with all applicable provisions of Municipal Ordinances,
State Statutes, rules and regulations of public authorities having
cognizance; further, that a copy of this Resolution be filed with the
Register of Deeds in and for Ramsey County, Minnesota.

Dear Sir:
This is written in response to the appeal of Dr. Charles H.
Williams to legalize and continue an existing and illegal
three - family use on property clas'sified in a "B" Residence
district.- The property is on the north side of Iglehart
Avenue between Milton and Victoria Streets and is described
as Lot 14, Block 19 Fairbank's Addition.
In 1889 the property was developed with,the existing struc-
ture, then.,a duplex. At some later date the structure was
extended to a three -plex without authorization.
The Board of Zoning heard the request on =December 16, 1965.
It was the Board's finding that it would be reasonable to
permit.a three - family use torcontinue for the remaining
life of the structure, subject to the changes as set forth
in the Bureau of Public Buildings and Housing Code Division
report dated November 18, 1965,- -a copy of which is attached,
and further subject to the applicant removing the existing
garage and providing the required three -car parking facil-
ity.
The Board of Zoning, therefore, recommends approval of the
appeal to continue the three - family use subject to the
conditions as outlined above, and if the Council grants the
appeal, suggests that the resolution be filed with the deed
in the office of the Regester of Deeds.

This letter is an appeal from a directive issued
by The Bureau of Public Buildings, City of St. Paul, dated
September 29, 1964 ordering Dr. Williams to discontinue the
use of his property located at 891 Iglehart Avenue, St.
Paul as a three -plex. The legal description of this pro-
perty is as follows:
Lot 14 Block 1 Fairbanks Addition
The property is presently being used as a three -
plex witha single apartment on the first floor plus two
apartments on the second floor.
The second floor',apartments each have separate
living rooms, porches, bedrooms, kitchens, baths, and entrances
and were originally designed and built to these specifications.

The original complaint filed by the Fire Prevention
Bureau states that the building has inadequate egress.
The owner, Dr. Williams, proposes to continue to
use the property as a three -plex.
The purpose of this appeal is to seek relief from
the directive issued by the Bureau of Public Buildings re-
quiring Dr. Williams to use the property in question only as
a duplex.

There is a need for this appeal because to require
Dr. Williams to abide the directive would result in his being
deprived of his property without due process of law.

The following is a list of items requiring alteration, repair or re-
moval to meet the minimum requirements of the Housing Code.and
Building Code.
BASEMENT: Install a vent on the laundry tubs.
Install a cap on the front clean out opening of the house
drain system.
Enclose the two heating plants and construction having
at least a one hour fire rating.
Install a handrail on the basement stairs.
ELECTRIC Remove the BX wiring system and other illegal wiring
methods used in the basement.
Install a receptacle for the laundry equipment and install
the proper size fuses in the branch circuits.
Repair or rebuild the basement steps in unit #32.
lst FLR. Install the proper drain connection from the kitchen sink
to the plumbing stack:
Install the proper vents on the first floor water closet
and bathtub.
Replace the kitchen floor covering in unit #1.
Remove the extension cords used to provide additional wall
outlets and provide at least two openings in the bedrooms,
living room and bathroom and three in the kitchen.
Install a handrail from the first floor to the second floor
and repair plaster as needed.

Remove the extension cords used for additional wall out-
lets and install wiring that would have at least two
openings in each room other than the kitchen which will
require three.
Repair the existing light fixtures.
Repair the plaster as needed on the second floor.
Repair the leaking flush tank in Apt. #3, and repair
the hatchway door.
EXTERIOR Repair the front porch and the stucco.
Paint the house trim.
Repair the garage cornice and doors and replace the
broken windows.
