RESOLVED, upon the pertinent appeal, under the Zoning
Code,,as amended, by Gerald E. Frisch, owner of the subject
premises, zoned in Commercial District, under said Zoning Code,
described as Lots 1, 2, 3, 49 5, and 6, in Block 1, in Larkints
Subdivision of Lots 1 and 2, Block 30, Suburban Hills Addition to
St. Paul, excepting therefrom that part thereof taken for trunk
highway purposes, to -wit: all that part of said Lots 3, 4, and
5 which lies northerly of the following described line: Beginning
at the northeast corner of Lot 12 of Block 1 Kingts Addition to
St. Paul, thence running easter7.y to the northeast corner
of Lot 3 of said Block 1 Larkints Subdivision of Lots 1 and 2,
Block 30 Suburban Hills iddition to St. Paul, according to the
plat thereof on file and of record in the office of the Register of
Deeds in and for Ramsey County, Minnesota, that the provisions of
said Zoning Code,, -in respect to density and land area requirements,
hereby are determined and varied, in their application to said
real estate, as and-to -the extent necessary therefor, and that a
permit hereby is granted--d-Unto said appellant and his successors
in interest, in respect of said real estate, for construction of
a 14 -unit apartment building to be constructed thereon, all in
accordance with plans therefor dated Received December 7, 1965;
and that otherwise, said appellant- permittee, and his successors
in interest, shall make due compliance with all applicable
ordinances, State statutes and rules and regulations of public
authorities having cognizance.

Dear Sir:
This is written in response to the appeal of Gerald E.
Frisch to relax the density standards on property located
on Griffith Street between Pacific Street and Point
Douglas Road, described as Lots 1,2,3,4,5, and 6, in
Block 1, in Larkin's Subdivision of Lots 1 & 2 in Block
30 in Suburban Hills, excepting therefrom that part there-
of taken for trunk highway purposes, to -wit: all that part
of said Lots 3,4, & 5 which lies northerly of the follow-
ing described line: Beginning at the northeast corner of
Lot 12 of Block 1, King's Addition; thence running east-
erly to the northeast corner of Lot 3 of said Block 1,
Larkin's Subdivision.
At the December 16, 1965, Board of Zoning meeting,.the
staff reported'that the applicant wished to construct a
14 -unit apartment building on a site with an area of
approximately 16,671 square feet. The required ground
area for a 14-unit apartment is 16,800 square feet and the
subject property is, therefore, 129 square'feet short, or:
0.77 %. The property is zoned Commercial.
The Board is of the opinion the deficiency in area is
minimal and, therefore, recommends the density standards
on the property be-relaxed and the appeal granted.

Gentlemen:
Application is hereby made for a variance in the land area require-
ment in connection with the development of the real property located on
Pacific Street at Point Douglas Road described as,
Lots 1, 2, 39 49 5, and 6, in Block 1, in Larkin's Subdivision
of Lots 1 and 2 in Block 30 in Suburban Hills, excepting there-
from that part thereof taken for trunk highway purposes, to -wit:
All that part of said Lots 3, 49 and 5 which lies northerly of
the following described line: Beginning at the northeast corner
of Lot 12 of Block 1, King's Addition; thence running easterly
to the northeast corner of Lot 3 of said Block 1, Larkin's Sub-
division.
There is delivered to you herewith copies of proposed plot plan for
the development of said tract with a 14 -unit apartment building together
with certified copy of land survey. This tract is presently zoned for resi-
dence "C" development and a part thereof being in the northwest portion was
taken for highway right -of -way purposes. The remainder of the tract contains
16;671 square feet as is certified to by said land survey. The ordinance
requirement respecting land area provides for a total of 16,800 square feet
for 14 -unit building in "C" residence zone. The requested variance is,
therefore, a very nominal one and amounts to only 129 square feet.
Request is also made that this application be processed with con-
sideration for informal approval by the Council of the variance. At the
present time construction of the building is being delayed pending the receipt
of this variance, the requirement of which was unknown until the land survey

was obtained. All plans to proceed with construction were made with the
assumption that the land area exceeded the amount required and the dis-
covery of the nominal shortage of land area has now stopped the construc-
tion progress. If informal approval can be granted we will then be able
to proceed with the construction at this time and still substantially meet
the previous work schedule. Without formal approval the construction of
the building could be delayed until next spring and we desire to avoid such
delay.
Your favorable consideration of requested`variance and informal
approval thereof will be greatly appreciated.

Dear Council Members:
I wish to protest the action of Gerald E. Frisch and his attempted
appeal to gain a permit to construct a fourteen unit apartment building
on the following property: Lots 1 thra 6, Block 1, Larkins Subdivision.
The described property is wholly inadequate to provide space for the
proposed building and proper parking space for the tenant's and their
quest's vehicles. Any prolonged use of the adjacent streets for public
parking is contrary to law and other than that, it will further compound
the traffic hazard at an intersection which already has two blind
corners. The safety of the Mounds Park School children from that area
should be considered.
In my estimation the property is sufficient for half of the
proposed units, but not fourteen. Therefore I object to Mr. Frisch's
appeal for a building permit. Will you please consider this letter a
11no" vote.
