the same; therefore, be- it • - '
RESOLVED, By, the Council of the City of St. Paul that the precise nature, extent and kind of im-
provement to be made by the said City is
to construct :a public sewer in alley of Block 1, Ella M.'Warren'a Subdivision of
Roger's and Sendrickts Acre Lots from Cottage Avenue to about 405 feet Southtof
Cottage Avenue
and the Council hereby orders said improvement to be made.
RESOLVED FURTHER, That the Commissioner of Public,Works be and is hereby instructed and
-directed to prepare plans and specifications for said improvement, and submit same to the Council for
approval; that upon said approval, the proper city officials are hereby authorized and directed to pro -
ceed with the making of said improvement in accordance therewith.

Subject: Petition of Remonstrance

The petition of remonstrance in the matter of construction of a
public sewer in the alley in Block 1, L. M. Warren's Subdivision
of Roger's and Hendrick's Acre Lots from Cottage Avenue to about
405 feet South of Cottage Avenue. The petition was referred by
the City Council to the Commissioner of Finance for check as to
sufficiency on January 11, 1966.
The City Charter, under Section 243 states in part:
"Each signer shall write his name and place of resi-
dence, give a description of the property owned and
the lineal frontage of same. Such petition may con-
sist of several papers, but the names of each separ-
ate paper or portions thereof shall be certified to,
under oath, by one of the signers thereof."
The petition is incorrectly prepared for the following reasons:
Legal descriptions of properties have not been included in
said petition.
Lineal frontage has not been included.
Said petition has not been duly notorized.

The matter will come up for hearing on Tuesday, January 18th, 1966.

To Members of the Council of the City of St. Paul
We would like to bring to your attention the fact that on the Petition to
have a storm sewer installed the name of Mrs Krengel appears with that of
Mr. Jorgensen and Mr. Albright.
On the petition of REMONSTRANCE Mr. Kidngel signed as opposed to have said
sewer constructed. Wouldn't this nullify the petition since three signatures
are required - and actually only two remain.
The signers of the petition of Remonstrance would like to know the verdict
of what affect it would have, and we would appreciate a note or call. If
you would like to call, you may do so at HU 8-8996 (the Vaughan home)

On Tuesday, January 18, 1966, the Council will meet to
decide if a public sewer is to be constructed in the alley of
Block 1, Ella M. Warren's Subdivision about 405 feet south of
Cottage Ave.(Preliminary Order 225617 -File 17024) The estimated
cost is $3,757.60 which is to be assessed at an estimated $4.17
per assessable foot.
Before making a decision on this proposed improvement we
would like you to consider the following facts:
1. The streets surrounding the block are all higher than
the center of the block thereby capturing water from
rainfall or melting snow until it seeps away.
2. When the ground is frozen the normal seepage of the
water into the ground is stopped and the water from
melting snow or early rains accumulate in the alley
without any means of escape.
3. When accumulation occurs the source of the water is
not limited to any one landowner, but from all landowners
in the block as all lots have some drainage to the alley.
Therefore, the water problem is the responsibility of
all landowners in the block not just the few who have
water on their property.
4. The water accumulates every Spring, without fail, and
reaches a usual depth of approximately 2 feet. In the
years of heavy snowfall like 1965, the water approached
4 feet. This water is also polluted due to various
animal manure, thereby causing a health hazard.
5. Particularly in the Spring, the water becomes an
attraction to all children in the area. Because of its
depth and volume the water is a potential drowning site.
6. The real estate and personal belongings of homeowners
in the middle of the block on both St. Albans and
Alameda Streets are being; damaged by water in the basements
and yards. During the Spring of 1965 the water from the
alley ran continously for 2 weeks into the sanitary sewer
in the basement of the home at 1349 N. St. Albans. A
temporary dam had. to be constructed in the back yards to
eliminate further costly damage to property as the yard
at 1341 N. St. Albans was also under water.
We feel the above facts show a definite need for a public
sewer in the alley. Your affirmative vote to proceed with the sewer
construction is respectfully requested.
