An ordinance amending Chapter
310 of the Saint Paul Legislative
Code pertaining to Non - intoxicating
Malt Liquor. This is an emergency
ordinance rendered necessary for the
preservation of the public peace,
health and safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.

That Section 310.02 of the Saint Paul Legislative Code
be'and the same is hereby amended by inserting in lieu and in place
thereof the following:
310.02.
a) "Any person desiring either "of the licenses --as
hereinbefore described shall first make an application
therefor to the Council of the City of St. Paul by filing
with the License Inspector of said City for presentation
by him to the Council of an application in writing there-
for, which said application shall set forth with reason-
able accuracy the name and place of residence of the appli-
cant, the exact location of the place at which the appli -,
cant proposes to carry on the business of selling non -
intoxicating malt liquors, and whether or not he has at
any time previous to the date hereof been engaged in said
business or in the business of selling food - stuffs in
the City of St. Paul, and if so, when and where. Said
application shall be signed by the applicant in person
or by an officer of the club seeking said license or by
an officer of the corporation seeking said license, and
when received by the License Inspector shall be by him
placed on file, and the name of the applicant shall be
by him registered in a book of registration to be kept
in the office of said License Inspector for that purpose;
provided, however, that said License Inspector shall not
receive such application or register the name of such
applicant unless the application is accompanied by a
receipt from the City Clerk provided for in the next
section.
b) No person, firm or corporation, other than a
_ bona fide resident of the City of St._ Paul, shall be '
granted an "On Sale" license as required in Section
310.01, except hotels as defined in Section 3+0.07,
Sub. 4, Minnesota Statutes. However, this restriction

Section 2.
That Section 310.07 of the Saint Paul Legislative Code
be and the same is hereby amended by adding thereto the following:
"It shall be unlawful to permit any minor to loiter
or remain in the rooms where non - intoxicating malt liquor
is being sold or served unless accompanied by his parent
or guardian."
Section 3.
That Section 310.08 of the Saint Paul Legislative Code
be and the same is hereby amended by inserting in lieu and in
place thereof the following:
"310.08. No such non - intoxicating malt, liquors
shall be sold either "On Sale" or 'Off Sale" between
the hours of 1:00 o'clock a.m, and.8:00 o'clock a.m.
on any weekday, Monday through Saturday inclusive,
nor between the hours of 1:00 o'clock a.m, and 12:00
o'clock noon on Sundays. No "On Sale'" licensee shall
permit any such non - intoxicating malt liquors to be
consumXed on its premises during the hours when the
sale thereof is by this ordinance prohibited."
Section 4.
That Section 310.12 of the Saint Paul Legislative Code
be and the same is hereby amended by inserting in lieu and in place
thereof the following:
"Section 310.12. It shall be unlawful for any per-
son duly licensed to sell non - intoxicating malt liquor,
but not duly licensed to sell intoxicating liquor, or
for any of his agents, servants, or employees, to keep,
store, possess, have under his control, sell, or permit
any person to keep, store, or possess any intoxicating
liquor upon said premises."
Section 5.
This ordinance is hereby declared to be an emergency
ordinance rendered necessary for the preservation of the public
_ __peace, health and safety.
Section 6.
This ordinance shall take effect and be in force upon
its passage, approval and publication.

shall not apply to persons, firms or corporations so
licensed on November 20, 1952. Furthermore, this re-
striction shall not apply to persons, firms or corpora-
tions who have a contract with the City of St. Paul per-
mitting them to sell non - intoxicating malt beverages
within said City."
c) Not more than one (1) "On Sale" license as re-
quired-in Section 3P.01 shall be directly or indirectly
issued to the same person. However, this restriction
shall not apply to persons who were licensed under this
chapter* on ���, ,S- j g (. 1
d) No license shall be issued or renewed if the
applicant within a period of five (5) years prior to
the date of such application has been convicted of vio-
lating any law relating to the sale of non - intoxicating
malt liquor or of intoxicating liquor.
e) Every applicant for an "On Sale" license, as
required in Section 310.01, shall file with his applica-
tion thereforO a bond•�in the sum of Two Thousand Dollars
($2,000). The surety on such bond shall be a surety
company licensed to do business in the State of Minnesota,
and the bond shall be approved as to form and execution
by the Corporation Counsel. Said bond shall be conditioned;`'
as follows :,
1) That the licensee „will pay to the muni-
cipality, when due, all taxes, license fees, penal- `
ties and other charges as provided by law.
2) That the licensee will obey the law
relating to such licensed business, and that
in the event of any violation of the provi-
sions of such law, the licensee will pay all
fines, penalties and other charges as provided
by law.
3) That the licensee will pay, to the
extent of the principal amount of such bond,
any damages for death or injury caused by or
resulting from the violation of any provisions
of law relating to the business for which such
licensee has been granted a license, and con-
ditioned that such recovery may be had from
the surety on the bond. The amount recover-
able shall be measured by,the actual damages,
provided, however, that in no case shall such
surety be liable for any amount in excess of
the amount of the bond.”
