226756s Ofl � na1 to City Clerk 4 226 756 ORDINANCE hd COUNCIL FILE NO. PRESENTED BY ORDINANCE NO. An ordinance amending Chapter 311 of the�Saint Paul Legislative Code pertaining to Taverns. This is an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. That Section 311.03 of the Saint Paul Legislative Code be and the same is hereby amended by inserting in lieu and in place there- of the following: "311:03. The fact that meals or luncheons are served shall have no effect, it being the intention of this ordinance to designate and define a tavern as set out in Paragraph (1) of 311.02." Section 2. That Chapter 311 of the Saint Paul Legislative Code is amended by deleting Section 311.05 therefrom. Section 3. That Section 311.07 of the Saint Paul Legislative Code be and the same is hereby amended by inserting in lieu and in place there- of the following: "311.07. Whenever an application for a tavern license is filed, the License Inspector shall refer said application immediately to the,Health Officers, the Chief of Police and the Fire Chief, who shall proceed to inspect and examine the premises described in the application and report to the License Inspector whether the applicant is a proper person to receive such a license and whether the premises are suitable for the business of a tavern. Upon receipt of the reports, the License Inspector shall trans- mit the said-reports together with his recommendation and - any recommendation that the Health Officer, Chief of Police and Fire Chief shall make with respect to the applicant or the premises, to the Council for its consideration. It is hereby made the duty of the Chief of Police in any case where consent of nearby residents is required under this ordinance, to inquire whether such consent was given in good faith." NELSON I am transmitting herewith amending ordinances to Chapter 310 of the Code, pertaining to Beer Licenses, and Chapter 311 of the Code, pertaining to Taverns, which have been drafted in accordance with your letter of request to this office, dated October 11, 1965. Also enclosed herein is an ordinance rescinding Ordinance No. 12983, C.F. No. 223161, approved May 13, 1965, pertaining to Beer License Bonds. This rescission is necessary because the bond re- quirement is being amended and is incorporated in Section 310.02(e) of the enclosed amendment. The enclosed three ordinances are approved as to form by our office, and if satisfactory to you, are ready for introduction to the City Council. If you have any questions, please contact me.
