COUNQA RESOLUTION - GENERAL FORM
RESOLVED, upon the pertinent appeal under the Zoning
Code by Frank J. Russo and Frances Russo, as owners of the subject
property situate in the City of Saint Paul, described as Lot 8,
Block 86, Leffmannts Subdivision of Blocks 86 and 87 of Lyman
Dayton-ts Addition located on the south side of E. Third Street
between Earl and 6ypress Streets, that the provisions of said
Zoning Code hereby are determined and varied in application so
that the premises may contain separate accommodations for several,
not in excess of three families, provided that the continuance of
such three - family dwelling be for the remaining life of the structure
now on said premises, and provided further, that the appellants
comply with the changes set forth in the Bureau of Public,-Buildings
and Housing Code Division report dated November 17, 1965, and
provided further that such permission shall lapse ipso facto
unless the appellants are in full compliance with the above
report, dated November 17, 1965, within one year from the date of
this resolution, and provided further, that the appellants provide
a total of three off-street parking spaces for said dwelling,
acceptance of this resolution and terms to be made by the
appellants, and subject to compliance with said provisions the
Council expressly finds that such relief will be consistent with
the public health and general welfare, and that said relief and
permission herein granted is subject to the further condition
that the appellants and their successors and assigns otherwise
shall make due compliance with all applicable provisions of Municipal
Ordinances, State Statutes, rules and regulations of public
authorities having cognizance • further, that a copy of this
Resolution be filed with the register of Deeds in and for Ramsey
County, Minnesota.

Dear Sir:
This is written in response to the appeal of Frank J. and Francis Russo to
legalize and,continue.a three - family residential use in an "A" residence
district on property located on the south-side of East Third Street between
Earl and Cypress Streets. The property is -described as Lot 8, Block 86,
Leffmann's Subdivision of Blocks 86 and 87 of Lyman Dayton's Addition to
the City of Saint Paul.
In 1915, the property was developed with a house and has a ground floor area
delineated by its foundation of 1,036 square feet. Because the property is
classified as "A" residence -which normally limits it to,the use of a one -
family residence;, the applicant must seek `Council authorization to continue
the use of the property as a three -plex.
The .Board of Zoning heard this appeal on December 2, 1965. The staff
reported that the off - streetparking requirement is being provided on the
site. It was the Board's findings that it - appears reasonable to grant the
appeal to cortinue the three- family'residential use subject to compliance
with changes set forth in the Bureau of Public Buildings and Housing Code
Division report dated November 17, 1965, a'copy of which is attached, and
subject to the applicant retaining,the..three off- street parking spaces.
It is; therefore, the Board of Zoning's recommendation that the appeal be
approved for the continued use of the building as a three -plex for the life
of the structure subject to the.above conditions. It is also recommended
that should the Council grant.,the appeal, a copy of the resolution be -�
filed with the deed in the Register- of Deed's office.

The following is a list of items requiring alteration, repair or re-
moval to meet the minimum requirements of the Housing Code and Building
Code.

1. The basement will require the proper vents installed on
the plumbing fixtures.
2. The kitchen sink on the first floor apartment on the
east side of the building requires a vent installed
on the kitchen sink.
3. The first floor apartment on the west requires the
installation of a vent for the kitchen sink. Also,
on the water closet and lavatory. The lavatory and
the sink also need additional repairs.
4. The kitchen on the second floor apartment does not have
the required light and ventilation as the window now
opens onto an enclosed porch. This will require the
installation of a new window directed to the outside.
5. Replace the sash cords in the kitchen windows of Unit 3.

Gentlemen:
I am writing to you on behalf of my clients, Frank J. Russo and Francis Russo,
his wife, who are the owners of property located in the City of St. Paul, County
of Ramsey, State of Minnesota, described as follows, to -wit:
Lot Eight (8), Block Eighty -six (86), Leffmann's Subdivision of
Blocks 86 and 87 of Lyman Dayton's Addition to the City of Saint Paul.
This property is located in the center of the block on the south side of
Third Street between Cypress and Earl Streets.
It is presently being used as a triplex. It is proposed to continue the above
use of the property.
The purpose of this appeal is to appeal from an order of the City Architect's office
ordering the owners to revert to a one - family dwelling.
This appeal is necessary as a reversion to a one - family unit would work a great
hardship on my clients. When my clients purchased this property in 1938, the
property was already being used as a duplex and my clients occupied the lower
floor and• had a tenant on the second floor. , At the time they purchased this property
in 1938, my clients retained the services of a licensed electrical contractor, namely,
Paul C. Nicol, who installed a separate meter for the electricity being used by the
tenant on the second floor. In March of 1946 when the Federal Government was
requesting people to reconvert their houses in order to make room for veterans in
need of housing, my clients applied to the Federal Goveri4ment and received a
priority to remodel their home into three units by re -doing the lower floor and
making it into two separate units. Permits to do this work were taken out with
the city in 1946.
This appeal is taken under Legislative Code Chapter 64. 03, Section 0,
Paragraph 2.
