WHEREAS, Thomas H. Shanley, Sr. has been employed by the
City of Saint Paul as a policeman; and
WHEREAS, employee contends that he has sustained a personal
injury in the nature of an occupational disease and has retained
an attorney, and has commenced a proceeding before the Industrial
Commission; and
WHEREAS, it is the employer's contention that the disability
_sustained by employee did not arise out of and in the course of
his employment with the City of Saint Paul; and
WHEREAS, the matter came on for hearing before the Industrial
Commission on September 2 and 3, 1965, and an Award has been filed;
now, therefore, be it
RESOLVED, That pursuant to-:.the Award of the Industrial Commission,
dated December 17, 1965, Thomas H. Shanley, Sr. be paid the sum of
$13,000.00 out of the Workmen's Compensation Account of the General
Fund, representing 288.88 weeks of compensation at the rate of $45.00
per week; that of said sum, the employer shall deduct and pay directly
to Robert E. Faricy, employee's attorney, the sum of $3,250.00 as
and for attorney's fees herein and in full satisfaction thereof,
and the balance of $9,750.00 shall be paid directly to the employee
in one lump sum;
• FURTHER RESOLVED, that the employer shall reimburse said attorney
the sum of $50.00 for costs herein for expert medical witness fees,
and pay directly, on behalf of the employee, the following to per-
sons and institutions stated: Minnesota Hospital Service Association,
$521.40; Drs. Michienzi, Dunn and Associates, $677.00; Thomas H.
Shanley, Sr., $177.30, reimbursement for hospital care, drugs and
medicines; that when aforesaid sums shall have been paid, it shall
constitute full, final and complete settlement of any and all employee's
claims against the employer, City of St. Paul, for personal injury or
