Shanley, Sr. has been employed by the City of Saint Paul as a policeman; and WHEREAS, employee contends that he has sustained a personal injury in the nature of an occupational disease and has retained an attorney, and has commenced a proceeding before the Industrial Commission; and WHEREAS, it is the employer's contention that the disability _sustained by employee did not arise out of and in the course of his employment with the City of Saint Paul; and WHEREAS, the matter came on for hearing before the Industrial Commission on September 2 and 3, 1965, and an Award has been filed; now, therefore, be it RESOLVED, That pursuant to-:.the Award of the Industrial Commission, dated December 17, 1965, Thomas H. Shanley, Sr. be paid the sum of $13,000.00 out of the Workmen's Compensation Account of the General Fund, representing 288.88 weeks of compensation at the rate of $45.00 per week; that of said sum, the employer shall deduct and pay directly to Robert E. Faricy, employee's attorney, the sum of $3,250.00 as and for attorney's fees herein and in full satisfaction thereof, and the balance of $9,750.00 shall be paid directly to the employee in one lump sum; • FURTHER RESOLVED, that the employer shall reimburse said attorney the sum of $50.00 for costs herein for expert medical witness fees, and pay directly, on behalf of the employee, the following to per- sons and institutions stated: Minnesota Hospital Service Association, $521.40; Drs. Michienzi, Dunn and Associates, $677.00; Thomas H.
