ORIGINA, O CITY CLERK CITY OF ST. PAUL OFFICE OF THE CITY CLERK C CIL RESOLUTION - GENERAL FORM COUNCIL 226592 FILE WHEREAS, Funds provided for Winter Street Maintenance are depleted, and WHEREAS, On December 6, 1965 a summons was served on the Mayor and Comp- troller questioning the legislative authority of the City Council to declare an emergency under Section 206 of the City Charter to provide additional funds for snow removal and related activities; and WHEREAS, Said court action has deterred the banking institutions, from whom the City normally borrows such emergency funds, from offering the same service to the City, and WHEREAS, In the event of an additional snow fall, the public health and safety will be impaired; therefore BE IT RESOLVED, That the Mayor and Comptroller be and they are hereby authorized and directed to borrow a sum not to exceed One Hundred Thousand Dollars ($100,000.00) and to execute and deliver to the party or parties making the loan a promissory note payable to such party or parties, bearing interest at the rate not exceeding five percent (5 %) per annum, said note to be payable one year from date of execution thereof, and be it, FURTHER RESOLVED, That the funds so borrowed be credited to the Emergency Snow Removal Fund, Activity Code 0254 R, all of the said Fund to be expended for the purpose of Snow Plowing, Snow Removal, Sanding and Salting Icy Streets, and N all other work needed to keep the streets in safe condition for winter driving, and o U w o BE IT FINALLY RESOLVER The Sinking Fund Committee shall negotiate a loan > '1 in the amount of one hundred thousand dollars ($100,000.00).
