FURTHER RESOLVED, That the Sinking Fund Committee shall negotiate a loan in an amount of $130,000; funds to meet this loan are to be borrowed from the Surplus Account of the General Fund, out of moneys to be received from payment of gross earnings tax -by Northern States Power Company pursuant to appropriate City Ordinances during the year 1966 at the time the first of such -payments from Northern States Power Company is received by the City of Saint Paul; -be it FURTHER RESOLVED, That repayment of said loan be accomplished by repayment from subsequent yearst budget funds with foreseeable revenues through charter amendment or through legal procedures which may be hereafter authorized by other legally constituted authority. PAUL COUNCIL NO. -) 0 6 OFFICE OF THE CITY CLERK COUNCIL RESOLUTION — GENERAL FORM PRESENTED BY COMMISSIONER DATE — WHEREAS, Funds heretofore appropriated for Workmen's Compensation costs and expenses during the calendar year 1966 are depleted; and WHEREAS, on December 6, 1965 a Summons was served on the Mayor and Comptroller questioning the legislative authority of the City to declare an emergency under Section 206 of the City Charter to provide additional funds for snow removal and related activities; and WHEREAS, the determination of the District Court in the aforesaid action has deterred the private banking institutions, from whom the City normally borrows such emergency funds, from offering the same service presently to the City; and WHEREAS, the Council, being duly advised in the premises, hereby finds and determines that the amounts heretofore appropriated to pay Workmen's Compensation costs and expenses incurred by the City of Saint Paul have become inadequate to properly protect the public interest, and the funds in Activity 0950 of Charter Fund 35 have been depleted, and the City has received and is receiving daily, bills from hospitals, doctors, and others, which it has been unable to pay because of the depletion of the aforementioned appropriation, now, therefore, be it RESOLVED, That the Council, for the reasons aforesaid, hereby finds that an emergency exists, and the Mayor and the Comptroller be and they hereby are authorized and directed to borrow a sum of money not to ^exceed $130,000, and to execute and deliver to the party or parties making such loan a promissory note, payable to such party or parties, bearing interest at a rate not exceeding five percent (5 %) per annum, said note to be payable one year from the date of execution thereof; be it FURTHER RESOLVED, That to Activity Code 0950 -R, of Chart to be expended for the purpose of charges and claims outstanding or the City of Saint Paul during the COUNCILMEN Yeas Carlson Nay, Dalglish Holland .mss Meredith Peterson xxxn Tedesco Mr. President, 200CM Byrne - Tn Favor A gainst the funds so borrowed be credited er Fund 35, all of said funds paying Workmen's Compensation to become outstanding against year 1966; be it Adopted by the Council 19— Approved 19— Mayor I DUPLICATE TO PRINTER�nL'/ ,> ' CITY OF ST.
