230586Council File No. 230586 —By Robert F, Peterson — Resolved, That upon the petition of Kroiss- Thompson Investments, Inc., those sections of public streets herein- after described be and the same hereby are vacated and discontinued as'public streets: That part of Oxford Street lying ' south of the Great Northern Rail- way Company right -of -way and north of a line parallel to and 60 feet north of the center line of the existing Roadway of Pierce Butler Route; also, that part of Hewitt Avenue lying north of a line 60 feet north of and parallel to the center line of the existing Roadway of Pierce Butler Route and lying east of the east line of Lexington Park- way and west of a line 150 feet easterly from and parallel to the east line of Oxford Street; subject expressly to the following con- ditions and reservations: 1. that the portion of the streets to be vacated be described as follows: that part of Oxford Street lying south of the Great Northern Railway Com- pany right -of -way and north of a line Parallel to and 60 feet north of the center line of the existing roadway of Pierce Butler Route; also, that part of Hewitt Avenue lying north of a line 60 feet north of and parallel to the center line of the existing roadway of Pierce Butler Route and lying east of the east line of Lexington Parkway and west of a line 150 feet easterly from and parallel to the east line of Oxford Street; ii 2. all the terms and conditions of Section 228 of the Legislative Code as amended regulating the procedure and pre- scribing conditions for the vacation of public grounds, streets, alleys, and highways in the City of Saint Paul; tainedhover the center easement 0 feet o4 Ox- ford Street, said easement lying be- tween the Great Northern Railway right -of -way and a line 60 feet north of and parallel. to the center line of Pierce Butler Route for the operation and maintenance of the existing sewers; 4• That a specific easement be re- tained over the westerly 20 feet of Oxford Street, said easement lying between the Great Northern Railway right -of -way and a line parallel to and 60 feet north of the center line of Pierce Butler Route to protect the interests of the Northern States Power Company and the Northwestern Bell Telephone Company; 5" that the petitioners pay to the City the sum of $6,740 as compensation for the vacation and provide the City with a bond in the amount of $2,000.
