1 WfIEREA5, on June 8, 2005 the Saint Paul City Council approved Council File No. OS-518 authorizing
2 the acceptance of and payment for easements on various properties nnpacted by the Concord Street
3 Sewer Project; and

5 WI�EREAS, the Ciry Council authorized payment of $45,400.00 to one of the property owners, Our
6 Lady of Gua.dalupe Chwch, for a permanent sewer easement and temporary construc6on easement, said
7 payment established by an appraisal of the fair market value of the easements; and
WFIEREAS, in its offer letter for the easements the City also included a 15% premium of $6,800.00 for
10 prompt conveyance of the necessary easements; and

12 WHEREAS, the properiy owner complied with the requested conveyance and therefore was entitled to
13 the premium; and

15 WHEREAS, Council File No. OS-518 did not include the premium in the amount authorized for
16 payment; now, therefore be it
17
18 RESOLVED, that the Saint Paul City Council directs and authorizes the proper City officials to pay said
19 property owner the remaining premium amount of $6,800.00, said sum to be chazged to Activity Code
20 C04-2T638-00000.

On 6/8/05 the City Council approved CF OS-518 authorizing payment to Our Lady of Guadalupe Church for easements related to the
sewer pro}ece. The Ciry offered a 15%premium on the easement value for prompt conveyance, which the church complied with. CF OS-
518 authorized the easement value, but not the premium. This resolution authorizes the remaining $6,800 premium.

WHEREAS, the City of Saint Paul ("City") is seeking to acquire property rights, including direct
purchase, permanent easements and temporary construction easements on, over, under and across
various properties in the vicinity of Concord Sfreet and Kansas Avenue in Saint Paul; and
WHEREAS, these properry rights aze necessary for the construction of a new storm sewer along
Concord Street between State Street and Kansas Avenue; and
WHEREAS, said properiy rights are needed for the following properties in Saint Paul:

WHEREAS, the City and the property owners have executed a purchase agreement (attached as E�ibit
"A"), an easement deed (attached as E�ibit "B") and a temporary construction easement (attached as
Exhibit "C"); and
WHEREAS, the City has conducted real estate appraisals to establish the fair mazket value of the direct
purchase and easements; and
WHEREAS, the Valuation & Assessment Engineer has recommended the purchase of said property
rights at their appraised values, and the values have been accepted by the property owners; now,
therefore be it
RESOLVED, that the Saint Paul City Council accepts the purchase agreement and subsequent deed, and
the permanent and temporary easements, and directs and authorizes the proper Ciry officials to pay the
property owners the above-listed amounts, said sum to be chazged to Activity Code C04-2T638-00000; �__,
