Marshall City G]--rk Building Dear Sir: SAINT PAUL, MINNESOTA 55102 A?0os October 4, 1966 This is written in response to the Appeal of Minnesota Mining and Manufacturing Company to establish a setback of zero feet from Forest & Duchess Streets on property located on the north side of Wells Street between Forest & Duchess Streets described as Lots 18, 19, 20, Block 3, Auditor's Subdivision # 7. The subject property was rezoned to Light Industrial on September 1, 1966 for this purpose. This matter was considered at the September 15, 1966 Board of Zoning meeting. There is a setback requirement of 33 feet from Forest Street and 26 feet from Duchess Street. A parking lot may occupy one -half of this setback space, or 16 1/2 feet from Forest 6 Duchess Streets. There are two apartments to the north which have had setbacks from Forest Street of 24 feet established by an Appeal in 1963. All of the dwellings in the block front on Forest Street. The garages for the duplexes at the north end of the block are either on or are setback within a few feet of Duchess Street. The appelant wishes to construct a• parking lot on the site and wants to establish a zero setback so that he may'save as many trees as possible on the site. It was the findings of the Board that it would be reasonable to grant the Appeal for the setback on Duchess Street since all of the dwellings in the block front on Forest Street, the frontage along Duchess Street being used as rear yards. It was also the Board's findings that the setback on Forest Street should also be relaxed since it would be more desirable to save the trees than it would to maintain the setback. Therefore, the Board recommends the Appeal be granted and the setback requirements be relaxed to zero feet on Duchess Street and Forest Street on the above described property. NEED FOR APPEAL: The required setback from Forest Street is 33 ft. 6 from'Duchess St. is 26 ft. for a parking lot, this setback is 1/2 that required for building 2, construction, or 16 1/2 ft 6 13 ft. respectively. The capacity of the parking lot would be reduced by one -half if the setba4s are adhered to. E. AREA ZONING: North 6 adjoining is "C" Residence; East is "B" Residence & Lt. Industry:,," 1 South is Light Industry, the rest of the area is zoned "B" Residence F. SITE CONDITIONS: The site is developed with a large frame dwelling and a two -car garage. There is a difference in elevation of 14 ft. from the south property line to the north property line. There are several large trees on the property " G. AREA CONDITIONS: All of the residences in the block front on Forest' -St. To the ' north E adjoining are two apartment buildings with a building line setback of ` 24 ft. established by Council action on August 31, 1963. Other residences in the block to the north have garages fronting on Duchess•,St. setback short distances.
