Resolved, That upon the petition of
Viking Drill and Tool Company, those
sections of public streets and a section
of public alley hereinafter decribed
be and the same hereby are vacated
and discontinued as public streets and
public alley:
All that part of De Soto Street from
the north line of Grove Street to a
line drawn from a point on the
west line of De Soto Street 20 feet +
southerly from the south line of
13th Street (formerly Woodward
Avenue) to the nortliwest corner i
f of Lot 7, Block 10, Brunson's Addi-
F tion to the Town of St. Paul in the
County of Ramsey and Territory of
Minnesota; also that part of Grove
Street lying east of the centerline
of De Soto Street and west of the
northwesterly line of 8th Street
extended northeasterly;
subject expressly to the following con -
ditions and reservations:
k 1. that the vacation be subject to all
t the terms and conditions of Section
228 of the Legislative Code, as
ff amended, regulating the procedure
P and prescribing conditions for the
j4 vacation of public grounds, streets,
and alleys and highways in the City
of St. Paul;_
2. that specific easements be retained
in that part of Grove Street being
vacated and in the south 60 feet of
that part of De Soto Street being
vacated to protect the interests of
the Northern States Power Com-
pany;
3. that a specific easement be retained
in Grove Street to protect the in-
terests of the Water Department of
the City of Saint Paul, with the
following specific requirements:
a. a permanent easement lb feet on
each side of the water "main;
b.the present grade to be main-
tained within the easement area;
c. no building construction to be
permitted within the easement
area;
4. that the petitioner pay .to the City
the sum of $3,800.00 as compensation
for the vacation and provide the
City with a bond in the amount of
$2,000.00.
Further Resolved, That the prior
resolution of this Council, C. F. 229279,
approved June 28, 1966, hereby is super-
seded said prior resolution .having
lapsed.
