RESOLVED, That the proper City officers are hereby
authorized and directed to enter into an agreement between the
State of Minnesota and the City of Saint Paul, a copy 6f which
proposed agreement is hereto attached and incorporated herein
,by reference as fully and as completely as if set forth herein
verbatim; and be it
FURTHER RESOLVED, That the City's costs of land acquisition
pursuant to said agreement, which costs of acquisition have been
estimated by the Public Works Department and the Office of the
Valuation Engineer to be in the amount of Six Hundred Thousand
Dollars ($600,000.00), shall be charged to PIR Fund 6000, to be
reimbursed from Bond Fund No. 7200- ST -32.

A G R E E M E N T
THIS AGREEMENT, made and entered into by and between the
State of Minnesota, hereinafter referr,ed to as the "State ",
acting by and through its Commissioner of Highways, and the City
of St. Paul, hereinafter referred to as the "City", acting by and
through the City Council,
WITNESSETH:
WHEREAS, the City has for a number of years recognized
the need for an additional heavy traffic volume east -west route
near Minnehaha, to supplement Maryland Avenue and East Seventh
Street, and the need for such additional route has become increas-
e ingly apparent with each passing year, and has reached the point
of being a critical need on the part of the City and its citizens
at the present time, and numerous studies by the St. Paul Traffic '
Bureau, the City Planning Board, and the Highway Department have
verified and confirmed the need for such additional route; and
?iiHEREAS, the project for such an additional route,_ v
between Mississippi Street and Payne Avenue had its inception
in 1952 with the recommendation of the Second United Improvement
Program Citizens Committee of the City of Saint Paul, and in
November of-1953 the project was approved by the electorate
of said City as a part of the Second United Improvement Program,
and followin,; the 1957 Legislative Session, the project was again
reviewed and approvers by the City Council and the Commissioner
of Highway: as a needed route, eligible for State Aid made
available by the Legislature at the 1957 Session, and since
that time the project has been continually reviewed and developed
and plans have been evolved throw', csoapel -ation between the City

Planning Board and the Department of Public Works and the
Highway Department for a facility integrated with and compatible
with the freeway system, the major arteries, and the local streets,
as well as preserving and protecting to the greatest degree possible
the land use plans, neighborhoods, and other local civic elements
of the City of Saint Paul; and
WHEREAS, because of the City's immediate need for an
alternative route as aforesaid, expressed through the area shown
in red and green on the print hereto attached and incorporated
herein by reference, the City has undertaken eminent domain pro-
ceedings pursuant to the provisions of its Charter by adopting
a Preliminary Order, identified as Council File No. 228933,
approved June 3, 1966, providing for the immediate acquisition
of lands or easements for street purposes in the lands shaded
"green" on the aforesaid print; and
WHEREAS, the Commissioner of Highways has determined
by definitive Orders, Centerline Order No. 396000, Width Order
39601, Access Order 39602, Slope Easement Order 39603, and B. R.
Order 39604, the necessary and definite location of Trunk Highway
212, as indicated in ''red" on the map attached hereto and incor-
porated herein by reference; and
WHEREAS, it has been determined that future traffic
needs will require this high;:ay to be constructed in the area
colored on the attached print;
NOW, THEREFORE, in consideration of the covenants and
conditions hereinafter set Forth in this Agreement, the City,
acting under the authority'vestc -d in it by its Charter, and the
State, acting through the commissioner of Highways under the
authority Eranted to him under Ei.nnesota Statutes 1965, Chapter
lrr -).20, Sued. 2, hereto mutually agree as follows:

I.
The State will acquire an easement at its expense
over the railroad properties and fee title to the privately
owned lands within those areas shaded in the color "red ",,
and the City will acquire at its expense fee title for street
purposes or slope easements where applicable to the lands
shaded in the color "green ", as indicated on the print attached
hereto and made a part hereof.
Ii.
The State will prepare the plans and specifications
for the construction of said highway.
III.
The State will provide all materials and supervision
required for the construction and completion of T.H. 212
situated within the limits of the area colored in "red" and
"green ", including grading, surfacing, three bridges, and frontage
roads, with tentative letting scheduled for June 14, 1968.
IV.
The City, prior to May 1, 1968, will obtain the'right
of entry for street purposes and will remove or cause to have
removed any and all structures situated within the limits of
the areas outlined in green.
V.
The City will remove or cause to have removed all
salvaged materials and /or debris caused by the removal of said
structures from the limits of the area outlined in "green" and
will have all foundation walls wrecked and removed down to ground
