1 WHEREAS, Neighborhood Housing and Property Irnprovement (NHPI) has requested the City
2 Council to hold public hearings to consider the advisability of revoking the rental registration certificate
3 for a single family rental property located at 340 STINSON ST and registered to Gerald Rassett and
4 Margazet Johnson; and
5
6 WHEREAS, on June 6, 2005 officers ofthe Saint Paul Police Department noticed a large group
7 of individua7s drinking bottles ofbeer on the public side walk in front of 340 Stinson Street. When the
8 offcers stopped at the residence most ofthe individuals ran inside 340 Stinson and closed the front door.
9 Police entered the house and found a number of juveniles throughout. The officers noted that the entire
10 front and back yards were littered with beer bottles and garbage, and that "the inside of the house was in
11 total disarray." Resident Daniel Joseph Hillxner was given a ticket for underage consumption. See: CN

WHEREAS, on June 16, 2005 officers ofthe Saint Paul Police Department were dispatched to
340 Stinson St. On a 911 hang-up. Upon arrival, the of&cers found four (4) underage individuals
drinkiug in the garage. (Including resident Daniel Hillmer). All four were cited for underage drinking.
One, Joseph Giefer, had an outstanding warrant and was taken into custody. See: CN 05121027; and
WHEREA5, on on May 27, 2005 of�cers of the Saint Paul Police Department were sent to 340
Stinson St. On an ananymous complaint of a loud party. Police found twelve (12) underage individuals in
the garage drniking. One individual, James Handt, was taken into custody on a misdemeanor underage
consumption warrant. See: CN 05103055; and
WHEREAS, on June 30, 2005 NHPI sent Gerald Rassett and Margaret Johnson the proper
Notice ofIntent to Revoke Rental Registration (copy attached); and
WHEREAS, Gerald Rassett and Mazgazet Johnson has not appealed said notice and the tnne for
filing an appeal has expired; now therefore
BE IT RESOLVED, that based on the foregoing, the Saint Paul City Council hereby adopts the
following findings and order conceming the subject property at 340 STINSON ST .
1.

That the subject property is a single family rental property that is required to be registered
with the City's Rental Registration Program.
That the holder of the Rental Registration Certificate far the subject property is Gerald
Rassett and Margaret Johnson.

That use and occupancy of the subject property has constituted a nuisance and continues
to be a nuisance.

The Saint Paul City Council hereby makes the following order:
l. The above-referenced Rental Registration Certificate issued to Gerald Rassett and
Margaret Johnson for the single family rental property at 340 STINSON ST, Saint Paul,
MN is hereby revoked.
2. It is further ordered that a copy of this resolution be mailed to Gerald Rassett and
Mazgaret 7ohnson.

Dear Mr. Rassett & Ms. Johnson:
I am writing to you in your capacity as the holder of a rental registration certificate for 340 Stinson Street, St.
Paui NIN. You are hereby notified, pursuant to the authority granted to me under Chapter 51 of the St. Paul
Legislative Code, of the City's intent to revoke the registration certificate for 340 Stinson Street. Based on the
foliowing facts I have determined that the use and occupancy of 340 Stinson Street constitutes a nuisance:
1. On June 6, 2005 officers of the Saint Paul Police Departrnent noticed a large group of individuais
drinking bottles of beer on the public side walk in front of 340 Stinson Street. When the officers
stopped at the residence most of the individuals ran inside 340 Stinson and closed the front door. Police
entered the house and found a number of juveniles throughout. The officers noted that the entire front

2. On June 16, 2005 officers of the Saint Pau1 Police Department were dispatched to 340 Stinson St, on
a 911 hang-up. Upon arrival, the officers found four (4) underage individuals drinking in the garage.
(Including resident Daniel Hillmer) All four were cited for underage drinking. One, Joseph Giefer, had
an outstanding warrant and was taken into custody. See: CN 05121027

drinking. One individual, James Handt, was taken into custody on a misdemeanor underage
