Whereas, In the matter of Comptroller's Contract L- 6695 -3 for the grading
and paving of MONTREAL AVENUE from West Seventh Street to I.S. #35E Connection;
,ELWAY STREET from Montreal Avenue to Shepard Road; SHEPARD ROAD from I.S. #35E
.Connection to 233 feet West of Elway Street, Barton Contracting Company, con -
,tractor, the specified date of completion is November 15, 1965, and
, Whereas, The Contractor has prosecuted the work diligently `end the pave-
ment was completed and opened to traffic by November 15, 1965, but the remain-
ing work of sodding, seeding and clean -up could not be done until the following
spring; so it was not possible to complete the contract by said date of com-
pletion, therefore be it,
' Resolved, That the proper City Officials be and they are hereby authorized
,and directed to execute an amendment to said contract extending the time of
completion to July 31, 1966 provided however, that this resolution shall have no
force or effect unless the sureties on the Contractor's bond consent thereto and
`file such consent in writing with the City Comptroller, and be it,
Further Resolved, That the City of Saint Paul hereby waives all claim
,for liquidated damages and that no engineering and inspection costs on this
project will be charged to the Contractor for such extended period.
