COUNCIL NO. 229794
WHEREAS, subsequent to a preliminary order in condemnation
the City of Saint Paul has negotiated a fair and reasonable pur-
chase price of $x+6,690.00 for that certain property described
as follows:
The southwesterly 19 feet of Lots 1, 13, 14,
15 in Mayallts Subdivision of Block 1 of
Whitney and Smith's Addition and Block 17 of
Robert and Randallts Addition Tn the City of
Saint Paul
and
WHEREAS, the price is to be paid in two installments and
an agreement has been prepared for such payment and conveyance
of the property between the vendor, United Properties Incorporated,
a Minnesota Corporation, and the purchaser, the City of Saint
Paul; now, therefore, be it
RESOLVED, that the proposed purchase agreement between the
United Properties Incorporated, a Minnesota Corporation,and the
City of Saint Paul, acting by and through its City Council,
approved as to form by the Corporation Counsel, be and the same
hereby is in all things approved, and the proper City officers
are hereby authorized and directed to execute said agreement
on behalf of said City.

City of Saint Paul, acting by and through its City Council,
approved as to form by the Corporation Counsel, be and the same

AGREEMENT
THIS AGREEMENT, made and entered into this day of
1966, by and between United Properties Incorporated,
a Minnesota Corporation, Party of the First Part, and the City of
Saint Paul, a Municipal Corporation, Party of the Second Part;
WITNESSETH:
That said party of the First Part in consideration of the
covenants and agreements of said party of the Second Part, herein-
after contained, and in consideration of the commencement of the

public improvements to be undertaken herein, agrees to provide to the
p.arty of the Second Part at execution hereof an abstract of registered
title, continued to date, evidencing. good marketable title in the party
of the First Part, together with all copies of leases, whether recorded
or not, pertinent to the property herein to be conveyed;
And said party of the First Part, in consideration of the covenants
and agreements of said party of the Second Part, hereinafter 'contained,
hereby sells and agrees to convey unto said party of the Second Part
by Warranty Deed, accompanied by a continuation of the registered pro-
perty abstract to the date thereof evidencing good title in the party of
the First Part, upon the prompt and full performance by said party of
the Second Part of this agreement, that certain tract of land, lying
and being in the County of Ramsey and State of Minnesota, described
as follows, to -wit:
The southwesterly 19 feet of Lots 1, 13,
14, 15 in Mayall's Subdivision of Block
1 of Whitney and Smith'.,; Addition and
Block 17 of Robert and ).iandall's Addition
To the City of Saint Paul
And said party of the Second Part, in consideration of the
premises, hereby agrees to p:r•, said party of the First Part, at Saint
Paul, Minnesota, as and for t1w purchase price of said premises the
sum of Forty -six Thousand Six Hundred Ninety and no /100 ($46, 690.00)
Dollars in the manner and at the times following, to -wit:
$4, 000. 00 on September 1st , 1966.
$42, 690. 00 on January 31, 1967, plus interest
of six percent per annum on said $42, 690. 00 from
September 1st , 1966, to January 31, 1967.
Said party of the First Part further covenants and agrees as follows:
to pay all taxes due and payable in the year 1966 and all special assessments
heretofore levied; it being understood and agreed as a condition hereof
that any subsequent sidewalk improvements on Jackson Street abutting
on or adjacent to the residual property owned by First Party shall not
be assessed to First Party by reason of First Party's payment of the
present sidewalk assessment covering the sidewalk to be removed by
reason of the widening of Jackson Street.
Party of the First Part further covenants and agrees that
said Party of the Second Part, its employees, agents, servants,
contractors, and subcontractors may, upon the execution of thi s
agreement, enter upon and commence the excavations and other works
necessary for the construction, installation, repair, and maintenance
of a public sewer on, under, and across said property;
IN TESTIMONY WHEREOF, The parties hereto have set their
hands the day and year first above written.
