Tighe, that section of public street hereinafter described be and the same hereby is vacated and discon- tinued as a public street: Beginning at a point on the east line of Kennard Street and the i south line of Old Hudson Road; thence southwesterly 120 feet to a point that is 43 feet westerly of the east line of Kennard Street; thence southerly parallel to and 43 feet westerly of the easterly line of Kennard Street to the north line of T.H. No. 12; thence easterly on the north line of T.H. No. 12 to the east line of Kennard Street; thence north on the east line of Kennard Street to point of beginning; subject expressly to the following terms and reservations: 1. That the description of the portion of Kennard Street to be vacated be described as follows: Beginning at a point on the east line of Kennard Street and the south line of Old Hudson Road; thence southwesterly 120 feet to a point that is 43 feet westerly of the east line of Kennard Street; thence southerly parallel to and 43 feet westerly of the easterly line of Kennard Street to the north line of T.H. No. 12; thence easterly on the north line of T.H. No. 12 to the east line of Kennard Street; thence north • on the east line of Kennard Street to point of begin- ning. 2. That the vacation be subject to all the terms and conditions of Section 228 of the Legislative Code, as amended, regulating the procedure and at prescribing conditions for the vacion of public grounds, streets, alleys, and highways in the City of Saint Paul. 3. That the petitioner deed to the City for street purposes as partial com- F ensation for the vacation the fol- lowing parcels: Except for vacated streets ac- cruing thereto, b e g i n n i n g at northwest corner of Hastings Avenue and Kennard Street; thence west 43 feet; thence north to ' Old Hudson Road; thence southeasterly to Kennard Street; thence to beginning in southeast- erly % of Section 134, Township 29, Range 22. Also, except for vacated streets acruing thereto, a tract 43 feet wide east of and adjoining Lot 13, Block 2, Wessel's Addition, and northerly of S.T.H. 12 -108 in the Southeast % of Section 34, Township 29, Range 22. 4. That the petitioner pay to the City the sum of $25 as compensation for the vacation and provide the City with a bond in the amount fo $1,000. Adopted by the Council August 4, 1966.
