WIYEREAS, pursuant to resolutions contained in Council
File Nos. 201140, adopted March 9, 1961, and 204546, adopted
October 31, 1961, copies of which are hereto attached, the
City entered into a certain land exchange with the Housing
,and Redevelopment Authority of the City of Saint Paul,
Minnesota, in Upper Levee Addition; and
WHEREAS, as a result of said land exchange certain
described properties as described in the aforementioned
- Council Files were conveyed by the City to the Housing and
-Redevelopment Authority; and
WHEREAS, inadvertently one of the deeds contained a mis-
.description of the land intended.to be conveyed; now, therefore,
be it
RESOLVED, by the Council of the City of Saint Paul, that
the proper officers are herewith directed to execute the at-
tached quit claim deed to the following described property:
All those parts of Lots 36 and 37, Upper Levee
Addition to St. Paul lying Northerly and North-
westerly of the following described line:
Beginning at the most Northerly corner of Lot
37; thence South along the West line of said
Lot to a point on said West line distant 112.45

Pursuant to resolutions, Council Files Nos. 201140, adopted March 9, 1961 and
204546, adopted October 31, 1961, the City thereafter conveyed certain lands
acquired by it for widening of Shepard Road in the Upper Levee Addition lying
Northwesterly of the Northwesterly right of way line of Shepard Road and excess
to street needs. The Authority conveyed to the City certain lands in Upper
Levee Addition required for Shepard Road. It was the intent of the parties
that the right of way line form the common boundary of their respective prop -
ekties.
By inadvertence the description of that part of Lots 36 and 37 conveyed to
the Authority used the proposed right of way line description of the initial
order for opening and widening Shepard Road (approximately shown by a green
line on the attached survey). The right of way line as finalized in the con-
struction plans for Shepard Road (shown by a red line on the survey) was more
Southerly than the former line.
The writer, consequently, requests that you request the City Council to authorize
a corrective quit claim deed in the form of the attached deed. The Authority has
conveyed Upper Levee Project to H. S. Kaplan Scrap Iron and Metal Co., Inc., and
the said deed and undertakings by the-Authority to perfect a title in Lot 12, parts
of Lots 34 and 36 are required in order for that company to obtain a mortgage. I
should sincerely appreciate your presenting the necessary resolution to Council
this week so that a deed can be executed and filed as early as possible in the
week of August 8th.

Paul, to be used for the widening and
extension of Shepard Road; and
Whereas, The Housing and Redevel-
opment Authority of the City of Saint
Paul has heretofore acquired, and is
now the owner of certain parcels of
land in the same area, to be used for
Upper Levee Project Minn. R -3; and
Whereas, The said City and the said
Authority have carried on negotiations
successfully for the exchange of par-
cels of land in said area, in order to
effectuate the purposes heretofore set
forth, which parcels are more partic-
ularly set forth in a plot plan attached
hereto, marked Exhibit A, and incor-
porated herein by reference;
Now, Therefore, Be It Resolved, that
the Council of the City of Saint Paul
hereby approves and authorizes the
exchange of certain lands to be con -
sumated in the following m a n n e r,
to -wit:
1. The City of Saint Paul shall ex-
ecute and deliver valid deeds of con-
veyance, to the Housing and Redevel-
opment Authority of the City of Saint
