LOSS Pursuant to resolutions, Council Files Nos. 201140, adopted March 9, 1961 and 204546, adopted October 31, 1961, the City thereafter conveyed certain lands acquired by it for widening of Shepard Road in the Upper Levee Addition lying Northwesterly of the Northwesterly right of way line of Shepard Road and excess to street needs. The Authority conveyed to the City certain lands in Upper Levee Addition required for Shepard Road. It was the intent of the parties that the right of way line form the common boundary of their respective prop - ekties. By inadvertence the description of that part of Lots 36 and 37 conveyed to the Authority used the proposed right of way line description of the initial order for opening and widening Shepard Road (approximately shown by a green line on the attached survey). The right of way line as finalized in the con- struction plans for Shepard Road (shown by a red line on the survey) was more Southerly than the former line. The writer, consequently, requests that you request the City Council to authorize a corrective quit claim deed in the form of the attached deed. The Authority has conveyed Upper Levee Project to H. S. Kaplan Scrap Iron and Metal Co., Inc., and the said deed and undertakings by the-Authority to perfect a title in Lot 12, parts of Lots 34 and 36 are required in order for that company to obtain a mortgage. I should sincerely appreciate your presenting the necessary resolution to Council this week so that a deed can be executed and filed as early as possible in the week of August 8th.
