Marshall erk g r: 229594 1 "'nza"5 written in response to the Appeal of Donald T. Boyce to legalize and continue an existing illegal, four - family use on property classified as "B" Residence. The property is located on the North side of Dayton Avenue between Fisk and Avon Streets and is described as Lots 15 6 16, Block 2, Nininger 6 Donnelly's Addition. In 1892, the existing structure was constructed with the ground floor delineated by its foundation of 1,200 square feet. At some later date, the structure was extended without authoriza- tion to a four -plex. Since the property is classified as "B" Residence, which would restrict it to a two- family use, the applicant must secure Council authorization under Chapter 64.03, Sec. o, par. 2, of the Legislative Zoning Code to continue the four - family use. The Board of Zoning heard this request on May 19, 1966. It was the Board's finding that it would be reasonable to permit the four - family use to continue for the remaining life of the struc- ture provided that the applicant comply with the changes as set forth in the Bureau of Public Buildings & Housing Code Division report dated April 28, 1966, a copy of which is attached, and further provided that four off -street parking spaces be provided on the property. It is also the Board of Zoning's recommenda- tion that should the Council grant the Appeal, a copy of the resolution be filed with the deed to said property in the office of the Register of Deeds. y Very truly yours, NRH /mm N. George Vavoulis, and The Members of the City Council of the City of St. Paul Court House Saint Paul, Minnesota Re; 805 Dayton Avenue Dear Sirs; 201 New York Bldg. 1-7 St. Paul, Minnesota December 6, 1965 I am the, present owner of the property located at the -above address on Dayton Avenue. I have recently received a letter from the Bureau of Public Buildings informing me that the above building is located in a " B " residential area. The building was originally constructed some years prior to 192. It was remodeled in 1922 and has been occupied as a 6 to 8 unit ki *nette multip9le dwelling property ever since that year. Court House records indicate that the real estate taxes have been levied on the basis Of such multipAl.e dwelling occupancy. It is presently biting occupied as 8 units on the first and second floor. The third floor is vacant and the basement is vacant. The building has a ground area of approximately 1200 square feet. The lot is approximately # 40 feet by 150 feet deep. There is ample of: street parking for at least 6 cars. If it is not possible for me to retain the present form of occupancy, I would like permission to remodel and reduce the occupancy SLED to four apartments conforming to the applicable Building and Housing CoSe standards as set forth by the City of St. Paul. like If-it please the Council, since the winter months are now present, I wouldA to have until early Spring to require those of my tenants 6501:musl, Ali 8 to find new lodgings.
