RESOLVED, upon the pertinent appeal under the Zoning
Code by Donald T. Boyceq as owner of the subject property
situate in the City of Saint Paul, described as Lots 15 and
16, Block 2, Nininger & Donnelly's Addition to Holcombe's
Addition to Saint Paul, located on the north side of Dayton
Avenue between Fisk and Avon Streets, that the provisions
of said Zoning Code hereby are determined and varied in
application so that the premises may contain separate
accommodations for several, not in excess of four families,
provided that the continuance of such four - family dwelling
be for the remaining life of the structure now on said
premises, and provided further, that the appellant comply with the
changes set forth in the Bureau of Public Buildings and Housing
Code Division report dated April 28, 1966, and provided further,
that such permission shall lapse ipso facto unless the
appellant is in full compliance with the above report, dated
April 28, 1966, within one year from the date of this resolu-
tion, and provided further, that the appellant provide a total
of four off - street parking spaces for said dwelling, acceptance
of this resolution and terms to be made by the appellant;and
subject to compliance with said provisions the Council expressly
finds that such relief will be consistent -with the public
health and general welfare, and that said relief and permission
herein granted is subject to the further condition that the
appellant and his successors and assigns otherwise shall make
due compliance with all applicable provisions of Municipal
Ordinances, State Statutes, rules and regulations of public
authorities having cognizance • further, that a copy of this
Resolution be filed with the register of Deeds in and for Ramsey

1 "'nza"�5 written in response to the Appeal of Donald T. Boyce to
legalize and continue an existing illegal, four - family use on
property classified as "B" Residence. The property is located
on the North side of Dayton Avenue between Fisk and Avon Streets
and is described as Lots 15 6 16, Block 2, Nininger 6 Donnelly's
Addition.
In 1892, the existing structure was constructed with the ground
floor delineated by its foundation of 1,200 square feet. At
some later date, the structure was extended without authoriza-
tion to a four -plex. Since the property is classified as "B"
Residence, which would restrict it to a two- family use, the
applicant must secure Council authorization under Chapter 64.03,
Sec. o, par. 2, of the Legislative Zoning Code to continue the
four - family use.
The Board of Zoning heard this request on May 19, 1966. It was
the Board's finding that it would be reasonable to permit the
four - family use to continue for the remaining life of the struc-
ture provided that the applicant comply with the changes as set
forth in the Bureau of Public Buildings & Housing Code Division
report dated April 28, 1966, a copy of which is attached, and
further provided that four off -street parking spaces be provided
on the property. It is also the Board of Zoning's recommenda-
tion that should the Council grant the Appeal, a copy of the
resolution be filed with the deed to said property in the office
of the Register of Deeds.

I am the,present owner of the property located at the -above
address on Dayton Avenue. I have recently received a letter from the
Bureau of Public Buildings informing me that the above building is
located in a " B " residential area.
The building was originally constructed some years prior to
192. It was remodeled in 1922 and has been occupied as a 6 to 8 unit
ki *nette multip9le dwelling property ever since that year. Court House
records indicate that the real estate taxes have been levied on the basis
Of such multipAl.e dwelling occupancy. It is presently biting occupied as
8 units on the first and second floor. The third floor is vacant and the
basement is vacant.
The building has a ground area of approximately 1200 square feet.
The lot is approximately # 40 feet by 150 feet deep.
There is ample of: street parking for at least 6 cars.
If it is not possible for me to retain the present form of
occupancy, I would like permission to remodel and reduce the occupancy

standards as set forth by the City of St. Paul.

630 University Avenue, Saint Paul, Minnesota.
The following is a list of items requiring alteration, repair or
removal to meet the minimum requirements of the Housing Code and
Building Code.
BUILDING:
The building is presently occupied with seven apartments
and it will be necessary that plans for converting the
property back to four units be submitted to the Building
Department for their approval.
ELECTRIC:
1.
Presently there is a 60 ampere entrance service at this
location; the existing service has several wires hanging
from it. It will be necessary that a new service of
adequate size be installed.

The open junction boxes must be closed in the basement;
open splices protected and extension cords used for wiring
the storage areas for Apts. 4, 3 and 11 must be removed.
3.
In the first floor bathroom, the light must be repaired.
4.
A faulty fixture must be repaired in the bedroom of Apt. 2.
5.
The extension cord providing light in the hallway must be
replaced with a light meeting Code requirements.
6.
The extension cord must be removed that goes through a
window to the front porch.
7.
The light for the back stairway must be repaired.
8.
The extension cords in the kitchen of Apt. 4 must be re-
moved.

9. The bathroom light fixture must be repaired.
10. Additional outlets must be provided in the bedrooms of
Apt. 4.
11. The porch wiring must be repaired.
12. The hallway light must be repaired.
No corrections were indicated for the third floor as this part of
the building may not be used for habitable quarters.
PLUMBING-'.
These items concern the plumbing system.
1. The hot water heater in the basement must have the flue
pipe repaired, the relief valve located on the water
heater.
2. A steel pipe serving as a waste in the southwest corner
of the basement coming from a sink on the second floor
must be replaced with materials meeting the Code.
3. The loop vent serving a sink waste from the first floor
must be re- designed so as to meet the Code requirements.
4. The waste connections that originally served as connections
for icebox drains should be removed and properly sealed
off at the stack.
5. The 11/4" steel pipe waste in the basement is run in such
a manner as to cause the water to be trapped. This re-
ceives waste from a sink on the first floor in the north-
west corner of the building.

7.
HOUSING:
1.
All gas range connections must be re- installed so as to
have a gas stop between the house piping and the gas range
connection.
The opening in the waste piping on the third floor where
a sink has been removed, must be properly capped.
The following items concern Housing Code requirements.
Redecorate walls and ceilings in all units.

2. Redecorate both bathrooms and repair the bathroom
floors.
3. Replace the floor covering in the kitchen of Unit 4..
4. Replace the floor covering in the kitchen of Unit 5.
5. Install a handrail in the stairwell to the basement.
6. Repair the basement floor.
7. Disconnect the gas jets in the basement.
8. Exterminate mice in the basement.
9. Supply covers for the garbage containers.
10. Repair the handrail on the exterior steps (east side).
11. Repair loose chimney bricks.
