RESOLVED, upon the pertinent appeal under the Zoning
Code, by Kieffer Bros. Investment and 6onstruction Co.,
owner of the subject real estate, situate in the City of
Saint Paul, located on the west side of Lexington Avenue
south of Randolph Avenue, more particularly described as
Lot 8, Fultonts Subdivision, and the northerly 75 feet of
Lot A, Fulton's Subdivision, partially zoned in "A"
Residence District and partially zoned in "C" Residence
District, under said Zoning Code, that the provisions of
said Zoning Code hereby are determined and varied in their
application to said real estate, as and to the extent
necessary therefor, and that a special permit hereby is
granted for the extension of the "C" Residence District
use presently permitted on a portion of said hereinabove
described real estate to all of the same; and be it

This is written in response to the appeal of the Kieffer
Bros. Investment and Construction Company to extend "C"
residence zoning over an entire site on property located
on the west side of Lexington Avenue, south of Randolph
Avenue. The property on which the extension of use is
requested is Lot 8, Fulton's Subdivision and the northerly
75 feet of Lot A, Fulton's Subdivision.
This matter was considered at the June 16, 1966 Board of
Zoning meeting. The applicant wishes to extend "C" zoning
to the lots and combine these lots with a large tract of
land to the north and west on which a high -rise apartment
is being constructed. If combined with the large tract, the
two lots will be used for driveways and maneuvering 4rea for
the parking lot of the apartment.
It was the finding of the Board that it would be reasonable
to combine these two lots with the larger tract of land so
these may be used for parking purposes.
Therefore, the Board recommends approval of the appeal to
extend the use of the two'lots.

Kieffer Bros. Investment & Construction Co., a Minnesota
corporation, hereby appeals to the Council of the City of Saint Paul
to permit the extension of a non- conforming use so as to permit the
maintenance of a driveway over and across the real property situated
in the City of Saint Paul, County of Ramsey and State of Minnesota,
described as follows, to wit:
1. Lot 8, Fulton's Subdivision;
2. The northerly 75 feet of Lot A, Fulton's Subdivision.

g. Purpose of appeal: The applicant is in the process
of construction of an apartment complex on Lot 7,
Block 1, Wardell Addition. The preliminary planning
for this development calls for a driveway or roadway
leading from Lexington Avenue to the site of the
buildings. All of Lot 7, Block 1, Wardell Addition,
has been rezoned to C Residential., It now appears
from the engineering studies of the typography that
the convenience of the public, as well as that of the
prospective tenants of the development, would best
be served by having the driveway wind in a wider arch
from the lower ground at or near Lexington Avenue up
to the elevation of the parking area and garage level.
In order to accomplish this suggested change, the
applicant has acquired by purchase Lot 8 and the
Northerly 75 feet of Lot A of Fulton's Subdivision.
Rezoning of the newly acquired property from A
Residential to C Residential will eliminate any doubt
as to the validity of the use of any portion of the newly
acquired parcels for driveway or roadway purposes.
h. Need of appeal: Recourse to the appeal procedure is
indicated by the nature of the change proposed. It would
appear that an extension of use is the appropriate manner
in which to handle the proposed change.

Juno Ave. lying between the E. line of vac. Nettleton
Ave. ekt. So. & the east line of Lot 18, Block 31, Howard
Green Add. extended south; 6 Lot 8 and the N'ly 75' of

This matter was considered at the June 16, 1966 Board
of Zoning meeting. The staff reported that the design
meets the design standards for this type of facility and
the Traffic Engineer has approved the plans.
Therefore, the Board of Zoning recommends approval of the
permit.
