Klindt for 25 foot setback West side of Ruth, between Old Hudson Rd. & Wilson Gentlemen: The City Council on June 30, 1966 referred subject appeal to the Building Department for recommendation. We have met with Mr. Klindt and.Mr. Adrian Brown of the Planning Department, and have discussed the matter with the Traffic Engineer. After considering the objections of the Pixy Pak Grodery Store adjacent to the south of the property in question and noting, while the Pixy Pak Building is built 60 feet back from the 'street, they were granted a waiver of the setback requirement for their parking lot from a 30 foot to a 15 foot setback under Council File No. 221410, it is our recommendation that the park- ing lot setback for the car wash be relaxed to the same figure and that the Council permit the applicant to provide his parking in front of the building to a line 15 feet west of the west line of Ruth Street in accordance with the plan enclosed herewith. Further, since the requirement for off street parking of forty automobiles in connection with a car wash operation is predicat- ed on an attendant - manned car wash and since this is a "serve yourself operation" in which the car owner will wash his car and each wash will take approximately fifteen minutes, a forty car parking lot would not be required to reasonably serve such an operation. It is our recommendation that the required off street parking be relaxed from forty to thirty cars as indicated on the enclosed plan. This has been discussed with the Traffic Engineer and the revised plan meets with his approval. Klindt to establish a 25 foot setback on property located on the west side of Ruth Street between Wilson Avenue and the Old Hudson Road described as the East 150 feet of Lot 2, Block 8, Hudson Road Gardens. This matter was considered at the May 19, 1966 Board of Zoning meeting. Since the adjacent lot to the north is zoned "A" Residence and the lots in the block are platted at a depth of 297 feet, the required-setback for all the lots is 20 percent of the depth or 60 feet. The property to the south which is Commercial has a 30 foot setback and the property to the north is vacant "A" Residential land. It was the findings of the Board that the 25 foot set- back would be reasonable since it would have no detri- mental effect on the adjoining property.
