PAUL FILE NO NO OFFICE OF THE CITY CLERK CIL RESQI,UTION— GENERAL FORM In the Matter of a hazardous building, being that certain two-story single family dwelling known and described as 492 Omaha Street in the City of Saint Paul and situated upon those premises legally described as Lot 9, Block 29, Subdivision of Blocks 28 & 29 in Stin- son, Brown and Ramsey: Addition to Saint Paul, according to the plat on file and of record in the Office of the Register of Deeds in and for the County of Ramsey, State of Minnesota. WHEREAS, pursuant to Resolution C. F. 230270, adopted September 21, 1966, a public hearing was duly held on October 11, 1966, before the Council of the City of Saint Paul upon due notice to Mrs. Mary M. (Royce) Fish and Mr. Jacob Gingold per- taining to the condition of -the structure located at 492 bmaha Street, Saint Paul, Minnesota; and WAEREAS, upon the facts presented at the said hearing, consisting of photograplW, inspection reports and the recommenda- tion of the City Architect, it was found and determined by the City Council that, according to the records and files of the Office of the Register of Deeds, the last record owner of the above described property is Mrs. Mary M. (Royce) Fish, that there is a mortgage in favor of Mr. Jacob Gingold, and that there are no other lien- holders of record; that it was further determined that the above- described building constitutes a hazardous building within the - definition of Chapter 393 of Laws of 1965 for the following reasons: a) COUNCILMEN Yeas Nays Carlson , Dalglish Holland Meredith Peterson Tedesco Mr. President, Byrne 8 The building has been completely damaged by fire and is in dange of collapse. FORM t =,OVED.- .,,?Adopted by the Council 19— Asst orporation In Favor Against Approved 19 Mayor X22 I 0. ;38 Page 2. b) One -third of the roof has collapsed and has fallen into the, interior. c) A large - section of the chimney is standing without support. d) The interior portions of the building are completely burned out. e) The-building, because of the above -,con- ditions, is beyond reasonable repair. f) The building is unfit for human habitation because of the absence of plumbing, electric and heating systems and because of the fire damage. g) That this building constitutes a nuisance and a hazard to the public health, safety and welfare because of it's physical damage, dilapidation and inadequate maintenance. now, therefore, be it RESOLVED, That in accordance with Chapter 393 of the Laws of 1965, and based on the foregoing findings of the Council, the Council of the City of Saint Paul does hereby make the following Order: 1. The owners of the above described building shall make the same safe and not detrimental to the public health, safety and welfare-,by razing and removing the said building and removing the materials therefrom from the premises within thirty (30) days of the service-of this Order. 2. In the event that the bdtlding is to be razed by the City of Saint Paul pursuant to judgment of the District Court, all personal property or fixtures which may unreasonably interfere with the razing and removal of this building shall be removed within ten (10) days from the entry of judgment; and if not so removed the City of Saint Paul shall remove and dispose of such persona property and fixtures as provided by law. 4. If the City of corrective action herein all will be assessed against the. as other taxes, be it FURTHER RESOLVED, and Incorporated Order herein the above- described property manner provided by law; be FURTHER RESOLVED, October 11, 1966, be and the Council action and Order.
