Trudeau, that section of public street hereinafter described be and the same hereby is vacated and discontinued as a public street: Lot 4, Block 4, Hersey - Woolsey Addition to St. Paul, Minnesota; subject expressly to the following conditions and reservations: 1. That the description of the vacation be described as follows: those parts of Lots 4 and 9, Block 2, Hersey - Woolsey Addition to St. Paul, Min- nesota, lying northerly of a line 60 feet northerly of and parallel with the center line of the existing paved roadway of the Pierce Butler Route, said center line being described as follows: Beginning at a point on the center line of North Syndicate Street 40 feet north of the point of intersection of said center line of North Syndicate Street and the south line of Block 2, Hersey - Woolsey Addition to St. Paul, Minnesota, produced easterly; thence westerly along a straight line 40 feet north of and parallel to the south line of said Block 2, Hersey - Woolsey Addition to St. Paul, Minnesota, a distance of 244.54 feet; thence on a curve to the right having a radius of 1,000 feet, delta angle 17° 42', to the point of inter- section with the center line of Short Line Street and there terminating; 2. That the vacation be subject to all the terms and conditions of Section 228 of the Legislative Code, as amended, regulating the procedure and prescribing conditions for the vacation of public grounds, streets, alleys, and highways in the City of Saint Paul; 3. That specific easements be retained to protect the interests of the Northern States Power Company and Northwestern Bell Telephone Company; 4. That the petitioner pay to the City the sum of $3,250.00 to cover the consideration for the , vacation of the portion of the street heretofore described and to cover the City's quitclaim deed to the petitioners for the vacated area;. 5. That the petitioner provide the City with a bond in the amount of 1.000.00; 6. hat the petitioner file an accept- ance of the terms of the vacation in accordance with the provisions of Ordinance No. 13309, said accept- ance to include a provision that the transaction will be completed within the time limitation set forth in Ordinance No. 13309, adopted August 10, 1966; be it R Further Resolved,. That the Commit- tee on Lands is hereby directed to proceed with the sale of said lands ruder the terms of Ordinance No. 18309, adopted August 10, 1966, and to report its findings and recommenda- tions to the City Council.
