RESOLVED, upon the pertinent appeal under the Zoning
Code by Arnold 0. Jacobson, as owner of the subject property
situate in the City of Saint Paul, describedes Lot,131 Block
10, Irvines Second Addition to Saint Paul, located on the
east side of Bates Avenue between North and Maury Streets,
that the provisions of said Zoning Code hereby are determined
and varied in application so that the premises may contain
separate accommodations for several, not in excess of three
families, provided that the continuance of such three - family
dwelling be for, the remaining life of the structure now on
said premises, and provided further, that the appellant
comply, with the changes set forth in the Bureau of Public
Buildings and Housing Code Division report dated June 13,
1966, and provided further that such permission shall lapse
ipso facto unless -the appellant is in full compliance with
the-�'-above report, dated June 13, 1966, within one year from
the,date of this resolution, and provided further, that the
appellant provide a total "of three. off - street parking spaces
for'said dwelling, acceptance of this resolution and terms
to be made by the appellant, and subject to compliance with
said provisions the Council expressly finds that such relief
will'be con sistent7' ith the public health and.general welfare,
and that said relief and permission herein granted is subject
to the further condition that the appellant and his
successors and assigns otherwise shall make due compliance
with all applicable provisions of Municipal Ordinances, State
Statutes, rules and regulations of public authorities having
cognizance; further, that a copy of this Resolution be`filed

Dear Sir:
This is written in response to the appeal of Arnold 0. Jacobson
to legalize`and,continue an existing illegal three - family use on
property classified in a "B" residence district. The property
is located on the east side of Bates Avenue between -North and
Maury Streets and is described as Lot 13, Block 10, Irvine*s-
2nd Addition.
In 1888 the existing structure was/ '-ructed with a ground

north.

Gentlemen:
I, Joseph R. Juneau,' am presently the owner of the property at 614 -6144- and
616 Bates Avenue, which is on the East Side of Bates Avenue One and One Half
Blocks North of East Seventh Street on the East Side of St. Paul, Minnesota.'
The legal description of this property is Lot- Thirteen (13), Block ten (10),
Irvins Second Addition to St. Paul. according to the plot thereof on record.-
I bought this property two and one half years ago from my brother -in -law and
at that time the building consisted of three rental units. I have continued
using the property, as a three unit building just as I bought it.' I have just
been informed that this lot is a Zone B and permits only a two family use:
Therefore, I idi-making an appeal to legalize the occupancy to the three units
which now exsists.
Two reasons I think you should consider strongly the legalizing of this property
are, that the property has been as such for at least the last 45 years which
would put the building older than the 1923 zoning ordinance., Also I have in
the last two and one half years put many dollars into this building and I am
presently short of funds to maintain the building properly. I presently have
the property for sale in the hands of a Real Estate Company and they have found
a carpenter who is interested in purchasing the property for investment,
providing it can be rented as three units. I am confident the new buyer is
going to remodel and fix.the building in time to the condition it should be in.'
I am appealing under the Legislative code,_Chapter 64.03, Section 110" Paragraph

The following is a list of items requiring alteration, repair or
removal to meet the minimum requirements of the Housing Code and
Building Code:
The first group of items are those considered to be of a hazardous
nature and must be corrected within 60 days from the date of the
approval of the appeal.
1. Remove all extension cords.
2. Replace the fusing with type "S" fuses of a size not
any larger than the wiring is designed to carry.
3. Rewire the basement as the wiring is now in BX and loom
systems with exposed 110 volt contacts.
4. Repair the chimney above the roof at the rear of the
building.
5.
Repair the
retaining wall at
the back of the property.
6.
Tighten-the
guard rail at the
top of the stairs at 616
Bates.
7.
Install a handrail
from the
top of the stair landing to
the second
floor hallway at
616 Bates.
8.
Repair the
north side steps
at 614 Bates.
9.

The following items must be corrected before the fall heating
season begins:
1. The gas space heater at 614 Bates is improperly installed
and will have to have iron gas pipe installed from the
basement to the heater and the unit must be re-adjusted
with an orsat test run and submitted to this department.
2. At 614/ Bates, the vent pipe of the space heater must be
supported in a proper manner.
3. At 616 Bates the space heater is not burning properly
and must have an orsat test run with the results sub-
mitted to this department.
The following group of items must be corrected within one year
from the date of the Council approval:
1. Additional electric outlets must be installed so there
&e at least two openings in every habitable room, one
of which may be a ceiling Light and three outlets in
the kitchen, one•of which may be a ceiling light. The
bathrooms must have at least one wall outlet and a
ceiling light.
2. A receptacle must be provided in the laundry area and
the brass socket removed for the light in the laundry
I rea and replaced with one meeting Code requirements.
3. The three kitchen sinks must have the waste replaced
and the fixtures must be vented.
4. The laundry trays are wasted through steel pipe connected
to the soil stack with a saddle. This connection is not
approved and must be replaced..
5. The clothes dryer as installed in the kitchen of 616 Bates
has the supply pipe running across the top of the floor
and across a doorway. This must be removed and the
piping properly made.
6. At 614 Bates, Apt. 1, the vent pipe should be sealed
from the space heater around its outer edges where it
enters the chimney.
7. Replace the rear door hardware.

8. Re- decorate where needed.
9. At 616 Bates, Apt. 2, material which is used to box
in the bathtub -is deteriorated and should either be
removed or replaced.
10. Replace the drain pipe from the bottom of the bathroom
hand lavatory to'the trap.
11. Replace the set of two steps on -the second floor landing.
12. Replace the door to the attic with a door of the correct
size.
13. The housekeeping in this unit leaves much to be desired.
The unit must be maintained in a clean and sanitary con-
dition at all times.
GENERAL STRUCTURE
1. Paint the entire exterior of the structure.
2. Repair the holes in the foundation to prevent the en-
trance of rodents:
3. Replace downspouts where needed.
4. Repair the exterior walls where needed.
5. Provide a sufficient number of garbage containers and
instruct the tenants as to their proper use.
6. Remove rubbish from the rear of the property and establish
a schedule for removal of rubbish.
