Resolved, That upon the petition of
Aaron- Hodroff and Sons Funeral Chap-
els, Inc., that portion of public alley
hereinafter described be and the same
hereby is vacated and discontinued as
a public alley:
The north 98 feet of the north -
south.alley in Block 2, Sylvan Park
Addition to the City of Saint Paul;
subject expressly to the following con-
ditions and reservations:
1. That the description of the vacation
be described as follows: the north
98 feet of the north -south alley in
Block 2, Sylvan Park Addition to the
City of Saint Paul;
2. That the petitioners dedicate to the
City for alley jpurposes the following
described Ian d: the south 22 feet of
Lots 2 and 3 and the north 20 feet
of the south 22 feet of Lot 1, all in
Block 2, Sylvan Park Addition to
the City of Saint Paul;
3. That the vacation be subject to all
the terms and conditions of Section .
228 of the Legislative Code, as
amended, regulating the procedure
and prescribl conditions for the

4. That the petitioners cause the newly
dedicated portion of the alley to be
graded and surfaced at their cost
and expense, said grading to be per-
formed pursuant to ordinance by the
City of Saint Paul according to plans
and specifications either approved or
provided by the Department of
Public Works;
5. That a specific easement be retained
to protect the interests of North-
western Bell Telephone Company;
6. That the petitioners pay to the City tE%
the sum of $150 as compensation for
the vacation and provide the City
with a bond in the amount of $5,000;
7. That the petitioner enter into a per-
sonal agreement with Mr. Grady
abutting property owner, wherein
the petitioner would agree to assume
further assessments arising out of
the improvement of the alley.
