Resolved, That upon the petition of
Roberts Construction Company, that
section of public alley hereinafter de -;
scribed be and the same hereby is
vacated and discontinued as a public
alley:
The west 54 feet of the east 132 feet
of the south M feet of the pulic
alley located in Block 1, Kiefer
Park;
subject expressly to the following con -
ditions.and reservations:
1. That the description of the portion
of alley to be vacated be described
as: the west 54 feet of the east 132
feet of the south I % feet of the
public alley located in Block 1,
Kiefer Park;
2. That the vacation be subject to all
the terms and conditions of Section
228 of the Legislative Code, as
amended, regulating the procedure
and prescribing conditions for the
vacation of public grounds, streets,
alleys and highways in the City of
Saint Paul;
3. That the vacation be limited to a
date forty years from the date of
the filing of the acceptance of the
vacation terms, or the life of the
building, whichever is the earlier
fdate, said condition not to preclude
minor repairs and alterations but
to exclude major repairs and altera-
tions during the term of the vaca-
tion; this condition to run with the
land and be binding upon,the owner
or owners and their successors in
interest: - — -, --
4. That the petitioner pay to the City
the sum of $150 as compensation
for the vacation and provide the
City with a bond in the amount of
$1,000.
