Fetersori �,/� �-6 (x�� lJ�� ORDINANCE NO, �...�? �•_L— An ordinance granting permission to Miller & Holmes Service Station, 721 Arcade St. to excavate for and constxuct certain gas and oil lines under the alley in Block 59� Arlington Hills Addition, The Council of the City of Saint Paul Does Ordain: ;` . SECTIOId 1 - ` �- • That permission and authority are hereby granted to Miller & Holmes Service Station f or its construction of three-3" gasoline fill gipes and one-1" fuel oil suction line under and across the alley in Block 59, Arlington Hills Addit�on between 16 feet and 22 feet westerly from the west line of Arcade Street. � , SECTION 2 •'. That the Comm3ssioner of Public Works is hereby authorized to issue a permit to iriiller & Holmes Service Station f or the aforesaid construction upon said permittee�s compliance with the f ollowing conditions: ' 1. Said permittee shall construct all said lines entirely at its own exgense, under the inspection and supervision and to the satisfaction of the Commissioner of Public Works, in accordance with plans and specifications to be filed with and � approved by said Commissioner. - . ' 2. Said permitteetsball pay the cost of any necessary engineering and , inspection of� said;wo'rk, and shall pay the cost of publication of this ordinance. r - � ' 3. Said p�rmittee shall properly protect all excavations made in subject alley, both day and night,. so as to avoid all damage or injury to persons or property, and shall properly fill and tamp all subject alley or other areas aff ected to avoid settling. 4. Said permittee, after the inception of said work, shall psosecute same continuously with dil3,gence, and fully complete said work r.o the satisfaction and , - approval of the Commissioner of Public �Iorks' at the earliest possible date. 5. Said permittee expressly agrees and undertakes to £ully indemnify and hold harmless the City of Saint Paul, its a�ents, officers, servants and employees from any and all damages, claims� losses, judgments, suits or expenses arising out of or occasioned by the performance of the work contemplated by this pernission and authority. . 6. Sa�.d permittee shall furnish a bond to the City of Saint Paul, in the sum of �� $10,000.00, conditione8` to comply with all the terms of this ordinance, anci to �� indemnify and save harmless said City f rom all liability, loss, judgments, suits� costs, charges� and expenses that may accrue to persons or property occasioned by said work ,� � � or arising out of the same. 7.: Said permittee shall, within thirty days after the passage of this ordinance� file with�the City Clerk a written acceptance of this ordintznce, its terms and A�� conditions. , - � SECTION 3 That thi's ordinance shall take effect and be in force 30 days after its passage, approval and publication.
