This a eement will not exceed thirty thousand dollars ($30,000) during the length of the ontract based upon the current need of five lease vehicles per month. That the Ci agrees to save and hold Supplier hannless from any and all claims arising ou of the City's use of vehicles hereunder and sha11, additionally, repair at its own e pense any damage sustained by the vehicles during the course of City's use, no al wear and tear excluded, and that in no event shall the liability of the City e ceed the limits set forth in MN Chapter 466. T the Caty shall be responsible for supplying each vehicle rented hereunder ' gasoline needed to make the vehicle operational, but no other maintenance ligations shall be the responsibility of the City. 7. That the City will not use any vehicle for a period of more than one year (365 days) without Supplier's consent, but the City reserves the right to request and receive from Supplier a replacement vehicle of a type and make as above- described at any time; time being of the essence in fulfilling requests for replacement vehicles. 8. That the city acknowledges the right of the Supplier to demand the return of the vehicle rented hereunder upon twenty-four (24) hours' notice to the City and upon such notice, the City will return said automobile. 9. That the use of the vehicle rented hereunder are for the use of the City's Polace O<j- ty� Deparhnent and for the purpose of the adnunistration o£ this agreement, Commander Todd f�ttell, 367 Grove Street, Saint Paul, Minnesota, (651}266-5619 shall be its liaison. � �S1a il. 12. 13. These five vehicles are going to be used for undercover work/ surveillance. The details of the lease are: - lease rate per vehicle is $15/day with a maximum monthly iease of $450.00 pius appiicable sales tax - The cost of the lease is capped at no more than $30,000 t'r�� - The lease is for one year - The City will provide the gas for the vehicles at no cost to dealer - The dealer wiA change the oil and inspect vehicles at no cost to City every 3,000 mifes - City will indemnify dealer for claims arising out of City use of vehicles and wiil repair any damage beyond normai wear and tear at no cost to the dealer This kind of arrangement has been used by the SPPD for years now. The SPPD is able to use multipie vehicles and prevent the puBlic/third parties knowing which vehicles are SPPD surrei(lance vehicles. Compared to the regular squad car lease, this is a fairly good deal. The 2�05 squad car lease is going to cost about $20 a day to lease ($178,000 cost for 2005 i 6 months =$29,666.67 / 50 cars leased = $593.33 cost per month per squad ! 30 days =$19.777777777). And the City has to maintain the squads. This lease requires the City to only provide gas for the vehicles and $15 per day. I would recommend approval of this lease. Eric December 28, 2004
