WHEREAS, Twin Cities Habitat for Humanity, inc. (zoning file #05-087-254) has submitted for City Councii
approvai the attached preliminary and final combined plat for subdivision of property at 1526 Ames Avenue, on the
south west corner of Hazeiwood, to create 6 reside�tial parcels, and
WHEREAS, the appropriate City departments have reviewed the piat and found, subject to the recommended
conditions, that it meets the requirements of Chapter 69 of the Zoning Code; and
WHEREAS, notice of a public hearing before the City Council was duly published in the official newspaper of the
City and notices were mailed to each owner of affected property including all property situated within 350 feet of the
subject property; and
WHEREAS, the City Council held a public hearing on the proposed plat on June 1 and 15, 2005, where all
interested parties were given the opportunity to be heard and the Council considered all the facts and
recommendations concerning the plat;
NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves the attached preliminary and
final piat for Germain Landing 2nd Addition at the south west corner of hazelwood, subject to the foliowing
conditions:
1. Common wall agreements and restrictions shali be recorded on deeds for all six lots, so that lots can
oniy be developed for attached houses, with copies of the deed restrictions and recording numbers
provided to the city.
2. The applicant shall file a copy of the Council Resolution approving the Germain Landing 2nd Addition
plat with the Ramsey County Recorder's O�ce.

E. ZONING CODE CITATION: §69.301 states that platting is required when a subdivision (1)
creates five or more lots or parcels each of which is 2'h acres or less in size, or (2) requires
paved streets, alleys and other public improvements, or (3) is previously unplatted land. §69.304
lists conditions for tot splits and adjustments of common boundaries. §69.406 provides criteria
for review of subdivision applications. These criteria are covered below under "Required
Findings."
F. HISTORY/DISCUSSION: In June of 2004, Habitat Humanity submitted a combined pfat for
Germain Landing to create 24 residential parcels and 5 outlots. A month latter, Habitat applied for
a rezoning from R2 single family to RT1 two family residential. After the rezoning was approved
they where granted a conditional use permit to construct a 30 unit residential cluster development
on the site.
G. DISTRICT COUNCIL RECOMMENDATION: District 2 had not commented at the time this staff
report was prepared.
H. REQUIRED FINDINGS: § 69.406 of the Zoning Code requires that all of the following f+ndings
shall be made prior to approval of a subdivision:
All the applicable provisions of the Legislative Code are complied with. City staff have
reviewed the proposed plat and have determined that all applicable provisions of city codes
are met subject to the condition that common wall agreements and deed restrictions be
recorded on the deeds for all six lots that the lots can only be developed for attached
houses. Freestanding single-family houses would not be permitted because the lots are too
small.
. 2. The proposed subdivision will not be detrimental to the present and potential surrounding
land uses. The proposed plat is consistent with the surrounding land uses, and will not be
detrimental to present and future use of surrounding land.

3. The area surrounding the subdivision can be planned and deve%ped in coordination and
compatibilify with the proposed subdivision. The area surrounding the proposed plat is already
developed and compatible with the proposed plat.
4. The subdivision is in conformance with the comprehensive plan. The subdivision is in
conformance with the housing chapter of the comprehensive plan, which calls for providing a
range of housing types and values. The comprehensive plan encourages developments
which promote good design solutions on smaller development sites and that complement
existing neighborhoods. tt also conforms with redevelopment plans for the area.
5. The subdivision preserves and incorporates the site's important existing natural features
whenever possible. The site is in a fuily-developed part of Saint Paul with no remaining
naturalfeatures.
6. All land intended for building sites can be used safely without endangering residents by peril
from floods, erosion, continuously high water table, severe soil conditions or other menace.
Tfie site is a flat, fully devetoped area with no flooding, erosion, high water ta61e or soif
condition problems.
7. The subdivision can be economically served with public facifities and services. The
subdivision can be economically served with public facilities and services from surrounding
streets.
STAFF RECOMMENDATION: Based on required findings 1 through 7, staff recommends
approvai of the finai plat for Germain Landing Znd Addition subject to the following conditions:
