WFIEREAS, a request has been received'from David Mortenson on behalf of the owner of the
property at 956 Concordia Avenue, Saint Paul, for the release of an easement originally taken by
Council File No. 249110, approved by the Council June 3, 1970, described as follows:
In the matter of condemning and taking an easement in the land necessazy for slopes,
cuts and fills including right of removal of lateral support ftom subject land or
remainder thereof, occasioned by excavations thereof or construction of slopes in the
grading and surfacing with bituminous material the alley in DONNELLY'S
ADDITION, BLOCK 2 from Chatsworth Street to Milton Street, as part of the Smmnit-
University Renewal Area, Contract 1969 G-1904-B; and .
i2 WHEREAS, the Saint Paul Deparhnent of Public Works has determined that it no longer needs the
�3 easement taken for the property at 956 Concardia Avenue, described as: LOTS 1 THROUGH LOT 4,
ia BLOCK 2, DONNELLY'S ADDITION TO ST. PAiTL; now, therefore be it

� � the Saint Paul Deparhnent of Public Works, the Council of the City of Saint Paul, on behalf of the City
ta for itself and on behalf of this deparlment, does hereby waive and release the above described
�s easement at 956 Concordia Avenue; and, be it fiu�ther

z� RESOLVED, that upon passage of this resolution, and receipt of the $300.00 fee from the property
22 owner, the City Clerk is hereby authorized and directed to record a copy of this resolution in the office
2s of the County Recarder, Ramsey County, and that the City Clerk shall maintain a copy of the
za Certificate of Intended Non-Use referenced in this resolution on file in the Office of Citizen Services.
